What the inspector wrote

On March 6, 2024, at 10:00AM, Licensing Program Analyst (LPA) Dayna Chambers conducted an unannounced complaint inspection to investigate the above allegation. LPA met with Site Supervisor, Angeles Orozco. At 10:30AM, LPA toured the facility with Site Supervisor, Angeles Orozco. Upon Arrival, LPA observed in RM#1 – Preschool: 8 children with 2 staff, and RM#2: Toddler Component: 3 children, and 1 staff. There was a total of 11 children and 4 staff. During today’s investigation, LPA obtained the LIC9040 children's roster and conducted interviews. The center has surveillance video which was observed by the Site Supervisor and Director on 02/22/24. The allegation was substantiated by the Director and Site Supervisor. The video showed Staff #1 violating Child #1’s personal rights. The Director and Site Supervisor self-reported to childcare licensing department. Conducted appropriate internal investigation. Staff#1 was immediately removed from the childcare center and blocked from ever obtaining employmet at the center. Through interviews and evidence collected, The “preponderance of the evidence” standard has been met. the above allegation is substantiated. Exit interview was conducted with Angeles Orozco, Site Supervisor. The Notice of Site Visit (LIC 9213) – must remain posted for 30 days. Failure to do so will result in a $100.00 civil penalty.

    Personal Rights 101223(a)(3). (a) The licensee shall ensure that each child is accorded the following personal rights: (3)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by: Based on interview and evidence collected, the licensee did not comply with the section cited above on 02/23/24 the center observed surveillance video which substantiating the incident Staff #1 to Child #1 which poses/posed a potential health, safety or personal rights risk to persons in care.
