    (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from...infliction of pain...other actions of a punitive nature including but not limited to: interference with functions of daily living including...sleeping. This requirement was not met as evidenced by Based on interviews S1 &S2 witnessed a sub staff put their leg on a child during nap time while the child stated they couldn't breathe. Sub Staff was immediately told to stop. This poses an potential risk to the safety and personal rights of children in care.

    Based on record review and interview, the licensee did not comply with the section cited above. The parent of Child 1 was notified immediately when Child 1 sustained a head injury on 2/26/25. Parent was notified approximately 2.5 hours later which poses/posed a potential health, safety or personal rights risk to persons in care.

(a) The licensee shall ensure that each child is accorded the following personal rights: (3)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by: Based on interview and evidence collected, the licensee did not comply with the section cited above on 02/23/24 the center observed surveillance video which substantiating the incident Staff #1 to Child #1 which poses/posed a potential health, safety or personal rights risk to persons in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    Based on observation and interview, the licensee did not comply with the section cited above due to LPA observing that Child #2 was alone with no adult supervision in Room #2. Staff #3 had to inform the Site Supervisor that LPA found Child #2 alone in Room #2 which poses an immediate health, safety or personal rights risk to persons in care.
