Based on observation and record review, the licensee did not comply with the section cited above in that 7 out of 28 children were not signed in which poses/posed a potential health, safety or personal rights risk to persons in care.

REPORTING REQUIREMENTS

101212(f) Reporting Requirements- ...Events reported shall include the following:...(E) Epidemic outbreaks. (f)The items specified in (d)(1)(A) through (H) above shall also be reported to the child's authorized representative.This requirement is not met as evidenced by: Based on interviews and record review, the licensee did not comply with the section cited above as facility did not report the outbreak of Hand, Foot, Mouth to the children's authorized representatives, which poses/posed a potential health, safety or personal rights risk to persons in care.

(g) The items specified in (d)(1)(E) through (G) above shall also be reported to the local health officer when appropriate pursuant to Title 17, California Code of Regulations, Title 17, Section 2500.This requirement is not met as evidenced by Based on interviews the licensee did not comply with the section cited above as the facility did not report to the local health officer the outbreak of Hand, Foot, and Mouth Disease, which poses/posed a potential health, safety or personal rights risk to persons in care.

HEALTH-RELATED SERVICES

Based on observation, the licensee did not comply with the section cited above in that one out of one children's medication does not have the original packaging which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on observation, Terro Spider Killer can was located on top of the refrigator in the ktichen area, the licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on observation, the licensee did not comply with the section cited above in Terro Spider Killer was located in on top of the refrifator located in the kitchen area, which poses/posed a potential health, safety or personal rights risk to persons in care.

ARTICLE 2. Administration of Child Day Care Licensing

Based on record review, the licensee did not comply with the section cited above in two out of five staff did not complete the Child Care Provider portion of the training, which poses/posed a potential health, safety or personal rights risk to persons in care.

101223.2(a) Any form of discipline or punishment that violates a child's personal rights as specified in Section 101223 shall not be permitted...This requirement was not met as evidenced by: Based on statement from original complainant and interviews with children and parents who disclosed staff pulled childs forearm and scolded a child, and hit a child, facility did not ensure childrens personal rights which poses an immediate health and safety risk to persons in care.

PERSONAL RIGHTS

101223(a)(3)The licensee shall ensure that each child is accorded the following personal rights: To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature. This requirement was not met as evidenced by:Based on interviews with parents and children in care who disclosed that teachers at the facility yelled at children in care.

TEACHER-CHILD RATIO

Teacher-Child Ratio. There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c). This requirement was not met as evidenced by: Staff #1 had completed 6 semester units but did not enroll in additional semester units after employment in September 2021. Staff #2 did not have any of the required 12 semester units to qualify as a teacher. Ratio was not met since both are not qualified as teachers.This poses an immediate health and safety risk to the children in care.
