What the inspector wrote

Licensing Program Analysts (LPAs) Cynthia Reyes and Mary Silva conducted an unannounced site inspection to investigate the above complaint allegation. This inspection is to ensure the health and safety standards as required by the regulations governing child care centers are met. LPA met with Teacher Sandra Hillier and Assistant director Arpine Patatanyan arrived about 30 minutes later. LPAs took a tour of the facility inside and out and took names of staff and census of children who were in the facility at arrival on this date. During LPAs tour of the facility, staff names and children census were taken. The facility was observed to be out of compliance. The facility is licensed for 52 preschool children and 6 toddler option children. LPAs observed the following listed below. Red (4/5 yr olds) class room: 5 children with 1 staff (Staff member left her 5 children in the red room alone while letting parents in the front of the school and walking their children to their classrooms. Staff member was also observed at the end of the LPAs tour to have had 1 toddler in the red class room with her other 5 children). During conversation with the children in this room, 2 children disclosed they were 6 years old and LPAs verified that yes, they are both over 5 years old. The facility is only licensed for preschool age 2 to 5 years old. Yellow (toddler option) class room: 5 children with 1 staff (Per file review and personnel report staff is only a teacher aid). LPAs also observed during a 2nd walk through 7 toddlers and the toddler room is only licensed for 6 toddlers. Green (2yr old) class room: 12 children with 2 staff (LPAs observed one toddler commingled with the preschoolers in this room). Orange (3/4 yr old) class room: 8 children with 1 staff. (This class room was outside on the play ground). Continue on next page Page 2 The following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children\342\200\231s health & safe. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Director, Lianna Navarardyan. Type A citation LPA Reyes informed Director, Lianna Navarardyan that this report dated 08/08/2024 document(s) (3) Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Reyes informed the Director, Lianna Navarardyan to provide a copy of this licensing report dated 08/08/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

    LIMITATIONS ON CAPACITY

    REPEAT VIOLATION: Limitation on Capacity and Ambulatory Status: A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement is not met as evidenced by: While LPAs did a 2nd walk though of the facility, LPAs observed the toddler option is licensed for 6 and had 7 toddlers in care in the yellow classroom. LPAs also observed 1 toddler commingling in the green, 2 year old class room and 2 children from the red class room are over the age of 5 as the facility is licensed for age 2 to 5 years old.

  • TEACHER QUALIFICATIONS AND DUTIES

    (c) To be a fully qualified teacher, a teacher shall have one of the following: (1) Twelve post secondary semester or equivalent quarter units in early childhood education or child development completed, with passing grades, at an accredited or approved college or university; and at least six months of work experience in a licensed child care center or comparable group child care program. This requirement is not met as evidenced by: Based on observation, interviews and record review, 4 staff are being used as teachers with out proof of teacher qualifications. This poses an immediate health and safety risk to the children in care.

  • TEACHER-CHILD RATIO

    REPEAT VIOLATION: Teacher-Child Ratio: There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. This requirement is not met as evidenced by: LPAs observed a staff member leave her 5 children in the red room alone while letting parents in the front of the school and walking the children to their classrooms. LPAs also observed this staff person, the staff from the yellow, green, & orange room used as teachers with no proof of qualifications This poses/posed a immediate Health and Safety risk to children in care.

  • ARTICLE 1. General Provisions and Definitions

    (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year This requirement is not met as evidenced by record review that all staff files reviewed do not have immunization records (MMR/TDAP/FLU) which poses/posed a potential health, safety or personal rights risk to persons in care.
