    (c) To be a fully qualified teacher, a teacher shall have one of the following: (1) Twelve post secondary semester or equivalent quarter units in early childhood education or child development completed, with passing grades, at an accredited or approved college or university; and at least six months of work experience in a licensed child care center or comparable group child care program. This requirement is not met as evidenced by: Based on observation, interviews and record review, 4 staff are being used as teachers with out proof of teacher qualifications. This poses an immediate health and safety risk to the children in care.

    LIMITATIONS ON CAPACITY

    REPEAT VIOLATION: Limitation on Capacity and Ambulatory Status: A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement is not met as evidenced by: While LPAs did a 2nd walk though of the facility, LPAs observed the toddler option is licensed for 6 and had 7 toddlers in care in the yellow classroom. LPAs also observed 1 toddler commingling in the green, 2 year old class room and 2 children from the red class room are over the age of 5 as the facility is licensed for age 2 to 5 years old.

  • ARTICLE 1. General Provisions and Definitions

    (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year This requirement is not met as evidenced by record review that all staff files reviewed do not have immunization records (MMR/TDAP/FLU) which poses/posed a potential health, safety or personal rights risk to persons in care.

This requirement is not met as evidenced by: LPAs observed a staff member leave her 5 children in the red room alone while letting parents in the front of the school and walking the children to their classrooms. LPAs also observed this staff person, the staff from the yellow, green, & orange room used as teachers with no proof of qualifications This poses/posed a immediate Health and Safety risk to children in care.

This requirement is not met as evidenced by: The facility is licensed for 52 preschool and 6 toddlers. LPA observed and counted a total of 66 children in care on this date. LPA observed the toddler option is licensed for 6 and had 12 in their class room. This poses/posed a immediate Health and Safety risk to children in care.

    Teacher-Child Ratio: There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. This requirement is not met as evidenced by: LPA observed 1 teacher in the graduation/orange class room attending to an injured child of the orange class and when LPA walked outside LPA observed 1 teacher alone with 23 children. The teacher that was inside with the injured child was suppose to be outside with the other staff and the other 23 children. This poses/posed a immediate Health and Safety risk to children in care.

This requirement is not met as evidenced by: LPA observed during file review and staff names taken, staff #9 & #10 are not fingerprint cleared to this facility. This poses an immediate risk to the health, safety, and personal rights of child in care. A civil penalty is being assessed.
