Based on observation,interview, and record review, the licensee did not comply with the section cited above in 0 out of 2 infants had sleep logs documented for 15 minute sleep checks, which poses/posed a potential health, safety or personal rights risk to persons in care.

1597.58 Civil penalties; regulations setting forth appeal procedures for deficiencies(c) The department shall assess an immediate civil penalty of five hundred dollars ($500) per violation and one hundred dollars ($100) for each day the violation continues after citation, for any of the following serious violations:(2) Absence of supervision, including, but not limited to, a child left unattended and a child left alone with a person under 18 years of age.1597.58 Civil Penalties (c)(2) The department shall assess an immediate civil penalty...for any of the following serious violations...Absence of supervision, including, but not limited to, a child left unattended and a child left alone...This requirement was not met as evidenced by: Based on interviews record review and licensee self reporting incident, a child was left unattended and unsupervised by licensee and/or licensee’s staff in a public setting.

102416.2...Reporting Requirements(3) Health and Safety Code Section 1597.467(b)(1) provides in part:"A report shall be made to the Department…following the occurrence during the operation of a family day care home of any of the following events:C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child." This requirement is not met as evidenced by record reviews.Based on interview and record reviews, Licensee failed to follow the protocol to submit licensing reports to file unusual incidents.This poses a potential health and safety risk to children in care.
