What the inspector wrote

On 05/18/23 Licensing Program Analyst (LPA), Araceli Gibson conducted an unannounced case management inspection. LPA met with Lead Teacher, Fabiola Reynoso, LPA explained reason for the inspection was to address an incident that occurred on 04/13/23. LPA conducted a tour of the facility and took a Census of (0). The Department was made aware of an incident in which the health, safety, and personal rights of children in care were alleged to have been violated. A teacher was notified by a child that two boys were in a bathroom stall together. The teacher saw a child 1 crawling out of a bathroom stall, while child 2 was occupying it. The two children were in a bathroom stall together for an unknown amount of time. The two children reported they were engaged in inappropriate touching when questioned. The Department investigated this incident and determined it was a lack of supervision on the part of the facility a type A citation was issued (see 809D). The facility did take measures by notifying Child protective services, notified authorized representatives, and did properly document the incident with Community Care Licensing. LPA informed the Licensee this is Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, Licensee to provide a copy of this licensing report that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and report was reviewed with the Director Leslie Oliveira. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiency is being cited: (see next page, 809 D). Licensee was provided a copy of their appeal rights.

    Responsibility for Providing Care and Supervision - No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: Based on records reviewed and interview there was a lack of supervision by a teacher, at the facility where an incident of inappropriate touching occurred due to lack of supervision. This poses an immediate risk to the health, safety, and personal rights of children in care.
