What the inspector wrote

Licensing Program Analyst (LPA), Melchisedeck Augustin made an unannounced Case Management visit and met with designated Center Director (CD), Theresa Sabatino, for the purpose of evaluating compliance with Teacher-Child ratio. During today's visit, LPA counted a total of 21 children in care with CD, a fully qualified teacher (S1) and one unqualified Aide (S2); and the children were dropped off at different/various times. At 9:27am, CD had to step away from the classroom which left two S1 & S2 to supervise 21 children, and the facility did not comply with the requirements of teacher-child ratio of California Code of Regulations (CCR) 101216.3 (b) . According to CD and staff, the facility had a total of 33 children enrolled into care and even at times when the facility experienced staffing shortage or was out of compliance with ratio requirements; the facility was not allowed to turn families away. LPA had a discussion with CD regarding concerns related to ratio requirements and CD understood the facility and/or Licensee (LS) would need to take proactive steps to prevent violation of ratio requirements by either not accepting children when the facility is at ratio or the LS would need to hire additional staff to assist in the classroom. Additionally, an interview with S1 & S2 confirmed on multiple occasions, the facility operated out of ratio, and on 03/21/24 the facility violated ratio requirements when it had between 27 to 28 children in care with CD, S1 & S2. Furthermore, the facility had several brochures, business cards and a facility website which was advertising with the intent of attracting clientele, and brochures and cards did not contain the facility number as required. Exit interview conducted and report was reviewed with the designated Center Director, Theresa Sabatino. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. The following violations of California Code of Regulations, Title 22; Division 12, were observed during today’s visit. Appeal Rights were provided.

This poses a potential health, safety and/or personal rights risk to the children in care.

  • TEACHER-CHILD RATIO

    The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance.This requirement was not met as evidenced by: Based on LPA's observation of S1 & S2 left alone to supervise 21 children at 9:27am. This poses/posed a potential health, safety and/or personal rights risk to the children in care.
