What the inspector wrote

Licensing Program Analyst (LPA), Melchisedeck Augustin made an unannounced Plan of Correction (POC) visit and initially met with the facility representative (S1), Citlalli Urzuamonero, for the purpose of evaluating compliance with Teacher-Child ratio. On 03/22/24, the facility was cited two type B deficiencies for not complying with Teacher-Child ratio requirements and for not recording the license number on the facility brochures and business cards which advertised with the intent to attract business or clientele. During today's visit, LPA counted a total of fifteen children in care with S1 which was a fully qualified teacher, one fully qualified teacher (S3), and an unqualified Aide (S2) without Early Childhood Education (ECE) units. Based on LPA’s observation, the facility was complying with the Teacher-Child ratio requirements of California Code of Regulations (CCR) 101216.3(b). The Notice of Site Visit (NOS) from prior visit on 03/22/2024 was posted on the facility entry door and the brochures/business cards were removed from the classroom until the license number is printed on them. LPA reviewed the facility’s website which was used to advertise and attract clientele, contained the license number as required. Approximately one and half hour later, the Licensees, Josephine Gerber (LS) and Kevin Gerber (LS1) respectively arrived to the facility, and at which time, LPA had a brief discussion with LS & LS1. According to LS and LS1's statement, the facility was in the process of hiring a Center Director and two qualified teachers to to ensure compliance with and to prevent violation of teacher-Child ratio requirements, and staff were anticipated to start or go through the on-boarding process within four weeks. LS stated once a new Center Director was designated to the facility, LS intends to submit a copy of the Director’s packet to the Department. LS confirmed the facility currently had a total of 27 children enrolled in care and if/when the facility experienced a staffing shortage and was at ratio, the facility would turn families away and not accepting children for the day; to maintain ratio requirements. (Continue to LIC 809-C) LPA reviewed one staff (S3) record at 9:06am which revealed S3’s record contained Personnel Record (LIC 501), Employee Rights (LIC 9052), required staff Immunization Record (IR), Emergency Medical Services Authority (EMSA) approved pediatric CPR/First Aid certification which expire on 01/09/25. Exit interview conducted and report was reviewed with Licensee, Josephine Gerber. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. The were no violations of California Code of Regulations, Title 22; Division 12, observed during today’s visit.
