What the inspector wrote

At 12:40pm on 10/28/2024, Licensing Program Analyst (LPA) Matthew Gallo met with licensee Nanci Castro Mirabel for the purpose of an unannounced annual inspection. Upon arrival, LPA observed a total census of 5 infants. Licensee guided LPA on a tour of the facility, and a health and safety inspection was conducted in all areas accessible to children. Prior to inspection, off-limits areas included all upstairs, garage, and front dock. During the visit, licensee stated that the front deck will now be used as on-limit area. A gate keeps the front stairs inaccessible from the deck, and licensee understands that this gate must always be closed whenever children are present on the deck. Updated off-limit areas include: all upstairs and garage. Licensee acknowledged that children must never enter these areas. LPA observed the required postings, a working phone, 2A10BC fire extinguisher, and functioning smoke and carbon monoxide detectors. Toxic and hazardous items are inaccessible to children. Per Licensee, there are no weapons in the home and LPA did not observe bodies of water on the property. The stairway and fireplaces are barricaded to prevent access by children. Outdoor play space is unfenced, and licensee acknowledges that 100% supervision is required in a all unfenced outdoor areas. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Report continues on 809-C LPA reviewed 5 children\342\200\231s files and observed them to be complete. Record review showed that the five children present throughout the inspection were all under the age of 24 months and therefore infants. A current roster is being maintained and fire and disaster drills are documented. Current CPR and First Aid certification was verified and expires 8/2026, and AB 1207 Mandated Reporter Training was verified for the Licensee and expires 10/2026. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. Title 22 deficiencies are cited on the subsequent pages of this report. Licensee acknowledges, that FOR TYPE A DEFICIENCIES ONLY upon receipt, licensee shall post LIC 809D with Type A deficiencies for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the licensee. LIC 9224 and Appeal Rights were provided. Report continues on 809-C Exit interview conducted and report was reviewed with the licensee, Nanci Castro Mirabel. A notice of site visit was given and must remain posted for 30 days.
