What the inspector wrote
Licensing Program Analyst (LPA), Duron conducted an unannounced inspection for the purpose of an annual Inspection. LPA and Director Emily Martinez toured the facility inside and outside. The floor and yard plan (LIC 999) were verified. Census was taken in each individual classroom. During the visit, there was a total of 68 children in care, 54 preschool age children with 11 preschool staff members and 14 toddler age children with 4 toddler staff members. Facility hours are Monday through Friday, 6:30 AM to 6:30 PM.
During the inspection it was determined the facility is operating within its licensed capacity and within compliance of staffing ratios. A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
During the inspection of the indoor activity space, items which could pose a danger to children (detergents, cleaning compounds, and medications) were observed to be stored out of the reach of children. Poisons/Hazardous Items are not kept on the premises.
Meals are provided by parents/authorized representatives. Food is properly stored. Floors, equipment, and furniture were clean and were observed to be in good repair and free of sharp edges.
There is drinking water available to children indoors by water cooler and disposable cups along with children’s individual sports water bottles with the child’s name on it. The children's bathrooms are clean and sanitary. Children nap on cots/mats, and bedding is stored individually and is taken home weekly to be washed by parents at end of week. The facility has conducted an emergency drill within the past six months. The facility has a working carbon monoxide detector and fire extinguisher.

The outdoor activity space was inspected for compliance. The playground was enclosed by a fence at least four feet in height. The surface of the outdoor activity space was well maintained and free of hazards. The cushioning material rubber mats commercially produced for the purpose around the climbing equipment, structures, slides and other similar equipment appeared to be enough to absorbs falls. Drinking water in the outdoor activity space is by water cooler with individual disposable cups along with children’s individual re-fillable water bottles. The outdoor equipment and toys were in good repair and free of sharp edges. There are no bodies of water present at the facility. The facility grounds were safe, sanitary and in good repair.
Staff files were reviewed for staff present during the facility inspection this date; 5 staff files were reviewed. Health screening and immunization's as required were reviewed. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a childcare center if he or she has not been immunized against influenza, pertussis, and measles.
Beginning March 31, 2018, H&S Code 1596.8662 requires all directors and employees to complete mandated reporting training, and to renew the training every two years. Teacher present possesses current EMSA approved child CPR/First Aid certifications, which expires on 8/8/2025.
Children's records were reviewed, and there was a separate, complete, and current record for each child. A random sample of 5 children's files were reviewed for documentation of the child’s name, address, and telephone number of the child’s authorized representative and of relatives or others that can assume responsibility for the child if the authorized representative cannot be reached when necessary (LIC 700) and a medical assessment. In the areas reviewed the children’s files were found to be in full compliance. Sign in/out procedure was reviewed for compliance. The person who signs the child in and out uses their full legal signature and records the time of the day.

requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). Facility outlet B tested with lead exceedance, facility no longer uses outlet B in Red star room for drinking and outlet has been turned off. Facility provides drinking water from Brita filtered water cooler refilled with water from outlet which results did not exceed the levels of lead.
Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Always place infants on their backs for sleeping.

Use only a tight-fitting sheet on the crib or play yard mattress.

Do not hang any items from the crib or above the crib.

Keep all items, including blankets, out of the crib or play yard.

Pacifiers may be used as long as they do not have items attached to them.

Infants should not be swaddled or have any items covering them while sleeping.
·
The temperature of the room should be comfortable enough for an adult to wear a t-shirt and not be too hot or too cold.
In the areas that were evaluated, no deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit.
Exit interview conducted and report was reviewed with the Director. A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights.
All appeals must be in writing and received by the Regional Office within 15 business days.
