What the inspector wrote

Page 2 LPA was unable to interview complaint because contact information was not provided. The complaint specified that the kitchen staff were not qualified to cover breaks in the classrooms. During LPA’s initial visit on 01/04/2023 and subsequent visit on 02/01/2023, LPA interviewed Director and a total of eight (8) staff members. 4 out of 8 staff members confirmed that the facility’s food specialist has covered them for their breaks. During LPA’s interview with the food specialist, they confirmed they have covered staff for their lunch breaks while children are napping. Staff also stated that it is on occasion when the facility is short staffed and when there is a teacher in the room with the specialist. In accordance with California Code of Regulation 101216.2 (e)(1) Teacher Aide Qualifications and Duties states (e) An aide shall work only under the direct supervision of a teacher. (1) An aide who is 18 years of age or older, and who meets the requirements of this section and Section 101216, may escort and/or assist children in going to the bathroom, and may supervise napping children as specified in Section 101230(c)(1), without being under the direct supervision of a teacher. Based on interviews conducted by LPA, the allegation unqualified staff were providing care and supervision to daycare children may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated. Exit interview was conducted with Director Andrea Silva. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100. Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. End of Report

This requirement is not met as evidenced by: Based on staff and parent interviews, staff have been out of ratio in their classroom on many occasions. This poses an immediate safety risk for the children in care.

  • BUILDINGS AND GROUNDS

    Buildings and Grounds 101238(a)(1): (a)The childcare center shall be clean, safe, sanitary and in good repair... (1) The licensee shall take measures to keep the center free of flies, other insects, and rodents. This requirement was not met as evidenced by: Based on interviews, staff disclosed they have observed a rat, as well as, droppings in classroom and provided photos. This poses an potential health and safety risk for the children in care.

  • CRIMINAL RECORD CLEARANCE

    101170(e)(1) Criminal Record Clearance Prior to working or volunteering in a licensed child care facility, all individuals subject to a criminal record review shall obtain a clearance or criminal record exemption. This requirement is not met as evidenced by: Based on staff record review and interview with Director, there is no criminal clearance for Gisela Hernandez who has been employed at the facility since 06/01/2021. This poses an immediate risk to the health and safety of children in care.
