RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision... (1)No child(ren) shall be left without the supervision of a teacher at any time...This requirement was not met as evidenced by: On 8/11/2025 facility reported an unusual incident report stating C1 was left alone in the classroom and found behind the classroom front door for 1 minute by S2.

101238 Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.This requirement was not met as evidenced by: Based on LPAs observations, interviews conducted. Restrooms had toilets with urine/dirt (mold) rings, paper towels on floors, sinks with dirt marking's, and toilets not flushed.Changing table had sand/dirt where children lay. Staff can not clean due to supervising children, ratio.

101223(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, …The licensee did not comply with the above regulation as evidenced by: Based on interviews, the licensee did not comply with the regulation above, which posed an immediate risk to the safety and personal rights of children in care. S1 grabbed and dragged C1, and forced C1 to pick up a toy.

PERSONAL RIGHTS

101223(a)(3) Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights: (3)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse... This requirement was not met as evidenced by: Based on video review and all interviews conducted, staff did not safely, physically redirect child from aggressive behaviors and move the child to a safe space. This poses an immediate personal rights risk to the children in care.

1596.8595(a)Each licensed child day care facility shall post a copy of any licensing report pertaining to the facility that documents...remain posted for 30 consecutive days. (3) Failure to comply with paragraph (1) shall result in an immediate civil penalty of one hundred dollars ($100). This requirement is not being met as evidenced by LPA's observations, no reports provided to facility during visit on 03/09/2023 were posted, this is an immediate health and safety risk to persons in care.

CRIMINAL RECORD CLEARANCE

101170(e)(1) Criminal Record Clearance Prior to working or volunteering in a licensed child care facility, all individuals subject to a criminal record review shall obtain a clearance or criminal record exemption. This requirement is not met as evidenced by: Based on staff record review and interview with Director, there is no criminal clearance for Gisela Hernandez who has been employed at the facility since 06/01/2021. This poses an immediate risk to the health and safety of children in care.

ADMISSION AGREEMENTS

101219 Admission Agreements (f) The licensee shall comply with all terms and conditions set forth in the admission agreement. This requirement was not met as evidenced as evidence by: Based on Director and staff interviews, facility does not provide enough supplies to accommodate children in attendance. This poses a potential risk to the health and safety of children in care.

TEACHER-CHILD RATIO

101216.3(a) Teacher-Child Ratio: (a) There shall be a ratio of one teacher supervising no more than 12 children in attendance except as specified in (b) and (c). This requirement is not met as evidenced by: Based on staff and parent interviews, staff have been out of ratio in their classroom on many occasions. This poses an immediate safety risk for the children in care.

BUILDINGS AND GROUNDS

Buildings and Grounds 101238(a)(1): (a)The childcare center shall be clean, safe, sanitary and in good repair... (1) The licensee shall take measures to keep the center free of flies, other insects, and rodents. This requirement was not met as evidenced by: Based on interviews, staff disclosed they have observed a rat, as well as, droppings in classroom and provided photos. This poses an potential health and safety risk for the children in care.

CRIMINAL RECORD CLEARANCE

101170(e)(1) Criminal Record Clearance. Prior to working or volunteering in a licensed child care facility, all individuals subject to a criminal record review shall obtain a clearance or criminal record exemption. This requirement is not met as evidenced by: Based on staff record review and interview with Director, there is no criminal clearance for Sandra Mariscal who has been employed at the facility since 01/23/2023. This poses an immediate risk to the health and safety of children in care.

Requirement is not met as evidenced by: Based on interviews and review of video footage, the facility failed to provide supervision, as Staff #1 found child left alone in the classroom. This poses an immediate risk to the health and safety of the children in care.
