What the inspector wrote

***This is an amended report to a report generated on 03/09/23*** On 03/09/2023, Licensing Program Analyst (LPA) Romy Castanon conducted a Case Management due to deficiencies observed during today's inspection. LPA briefly met with Director Andrea Silva who was in the infant classroom and explained the reason for today’s visit. During a self guided tour, Assistant Director Aimee Valentin escorted LPA. A tour of eight (8) individual classrooms was conducted and census was taken. Observed at the time of the visit was a total of 66 children and 7 staff members. One classroom was unoccupied. A review of the Facility Personnel Report Summary on 03/09/2023 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions, with the exception of Gisela Hernandez. LPA informed director during previous visits that a list of staff, including staff Gisela was not listed as associated to the facility on report summary. Staff Gisela had her fingerprints taken on 05/13/2021, started working at the facility on 06/01/2021, then was sent again to complete a livescan on 07/08//2021. Director sent association packet to Regional office and allowed staff Gisela to continue working at the facility without confirming she was cleared to work. Upon further review of the staff personnel file and Guardian records, documents needed to complete the clearance process have not been submitted, therefore the initial clearance application was closed and a fingerprint clearance does not exist for staff Gisela. This is the second citation in the past 12 months for an uncleared adult working at the facility. A civil penalty is being assessed today. Based on LPA’s interview conducted with Director, the facility is being cited in accordance with California Code of Regulations, Title 22, Division 12, Section 101170(e)(1) Criminal Background Clearance for one (1) staff not cleared to work at the facility. Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. Licensee shall have LIC9224 (Acknowledgement of Receipt) signed and kept in each child's file. Exit interview conducted and report was reviewed with Director Andrea Silva. Appeal Rights were discussed. A notice of site visit was given and must remain posted for 30 days. (End of Report)

This requirement is not met as evidenced by: Based on staff and parent interviews, staff have been out of ratio in their classroom on many occasions. This poses an immediate safety risk for the children in care.

This requirement was not met as evidenced as evidence by: Based on Director and staff interviews, facility does not provide enough supplies to accommodate children in attendance. This poses a potential risk to the health and safety of children in care.

  • BUILDINGS AND GROUNDS

    Buildings and Grounds 101238(a)(1): (a)The childcare center shall be clean, safe, sanitary and in good repair... (1) The licensee shall take measures to keep the center free of flies, other insects, and rodents. This requirement was not met as evidenced by: Based on interviews, staff disclosed they have observed a rat, as well as, droppings in classroom and provided photos. This poses an potential health and safety risk for the children in care.

  • CRIMINAL RECORD CLEARANCE

    101170(e)(1) Criminal Record Clearance Prior to working or volunteering in a licensed child care facility, all individuals subject to a criminal record review shall obtain a clearance or criminal record exemption. This requirement is not met as evidenced by: Based on staff record review and interview with Director, there is no criminal clearance for Gisela Hernandez who has been employed at the facility since 06/01/2021. This poses an immediate risk to the health and safety of children in care.
