What the inspector wrote

On 2/27/2024 Licensing Program Analyst (LPA) A. Silva conducted an unannounced Came Management – Other visit to investigate an unusual incident report. Upon arrival, the LPA met with Director Derek Weinmann and informed them of the purpose of the visit. A review of the Facility Personnel Report Summary shows all facility staff or individuals who require caregiver background checks have received a criminal record clearance and a child abuse index clearance or an exemption clearance. The census at the time of the visit was 69 children and 9 staff The Department received an incident report on 2/22/2024 alleging the toddler program classroom has been operating over capacity and/or out of the fire clearance with 17 children in attendance supervised by four staff. On 2/27/24, LPA Silva attempted to reach the reporting party unsuccessfully. Interview with Parents: On 2/21/2024, LPA Silva called nine (9) parents requesting an interview. These interviews were originally conducted in association with Complaint Number 06-CC-20231220114609 in which the complainant makes similar allegations about ratios. Four of the nine parents were reached and interviewed. None of the parents interviewed expressed any concerns about the care and supervision provided to children at the facility. Records Review and Observations: On 2/21/2024, LPA Silva reviewed the LIC999 Facility Sketch and the facility’s capacity specified in the latest license issued to the facility. This records review was originally conducted in association with Complaint Number 06-CC-20231220114609 in which the complainant makes similar allegations about ratios. The license capacity is not specific to any one specific room, but rather to the facility. The complainant made allegations about a toddler program. However, the facility is not licensed for a toddler program. Based on a file review, a case management - licensee initiated visit dated 09/06/2017 shows the facility is licensed for a total capacity of 103 children in rooms C, D, E, F, G, I, and J. Rooms A and B are under a different license and different capacity and conditions, which is also reflected in the license. Based on the interviews conducted and records review, the preponderance of evidence standard has not been met. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated. An exit interview was conducted with Director Derek Weinman. The Notice of Site Visit was posted during the visit. The director was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First-level appeals should be sent to the regional manager to the address listed above. END
