What the inspector wrote

Licensing Program Analyst (LPA) Dean Thompson conducted a case management inspection, in conjunction with another inspection at the facility. During the visit, LPA toured the facility inside and outside. Upon entry, LPA didnt observe any staff inside the office. LPA walked up the hall, then entered the Pre-K classroom at 8:12 am and observed staff #2 (S2) alone, caring for 13 preschool age children. LPA asked S2 how many children she had in care and S2 replied 12. LPA counted and informed S2 there were 13 children present. At 8:16 am another parent came inside the Pre-K class room to drop off an additional child and S2 stated "I have 14 now." 101216.3(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c). LPA observed S2 bring two children across the hall into the preschool classroom with staff #1 (S1) who stated she was the person in charge until the director arrives. LPA met with director America Lopez at her time of arrival at 8:48 am. Director provided LPA with staff clock in times and face to name transition sheets. A review of staff records on this date indicates that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions. During the inspection it was determined the facility is not operating within compliance of staffing ratios. In the areas that were evaluated, one Type A deficiency was observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. 101216.3(a) Teacher-Child Ratio. Continue to Page 2 Page 2 LPA Thompson informed Director America Lopez that this report dated 5/17/2023 document(s) one Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Thompson informed Director America Lopez to provide a copy of this licensing report dated 5/17/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and report was reviewed with the Director America Lopez. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal Rights and deficiencies were discussed. Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.
