What the inspector wrote

Page 2 On 12/09/2026, the Orange County Child Care Office received a complaint alleging: Staff did not prevent a child from harming other children in care. The Reporting Party (RP) stated there has been ongoing safety issues in the 2-year-old classroom over the past several weeks involving repeated behavior from Child 1 (C1), that has resulted in harm or risk to other children. While the day care staff\342\200\231s efforts are appreciated these recurring issues must be addressed. During the investigation, LPA toured the facility on 12/11/2025, 01/14/2026, conducted classroom observations, obtained documents; Personnel Report LIC500, Children\342\200\231s Roster, Family Brochure, Staff Handbook, Behavior Plan, Children\342\200\231s names who have transitioned from infants between October-December, and conducted 4 (four) staff interviews (S1-S4), children did not qualify to be interviewed due to limited vocabulary, During facility inspection on 12/11/2025 LPA conducted classroom observations in the younger 2\342\200\231s classroom and observed 1 (one) staff supervising/caring for 10 (ten) children in the carpet area using props as they read a book to the children. Children were engaged and listening to the story. Once the story was completed Staff 1 (S2) set up a Lego activity at the tables and ensured children were engaged in the activity by talking with them and showing them the different Legos. Once children were engaged S1 walked to the changing table and changed a diaper. During diaper changes Staff 1 (S2) kept watch of the children and provided feedback to the children while they were engaged in the activity. On 01/14/2026 LPA conducted a second inspection and observed younger 2\342\200\231s classroom in the carpet area. 2 (two) staff were present and 9 (nine) children. 1 (one) staff was holding a tambourine and calling out the children\342\200\231s names as they would stand up, they would dance and then sit down, the other 1 (one) staff in the classroom was at the diaper changing table changing diapers. Page 3 LPA interviewed 4 (four) staff (S1-S4) that stated they provide care and supervision to children by keeping watch on them at all times. 4 (four) staff interviewed stated if they did witness a child who was experiencing behaviors that need adult guidance they would intervene in positive ways by; redirecting the child, shadowing the child, giving the child small task, partnering with the parent, and if they (staff) see a child has repeated behaviors that needs adult guidance that they would create a behavior plan with the parents that can help the child with different types of support. 3 (three) staff interviewed stated there is an app that staff use called My Path that gives staff different ideas or activities to support children in the classroom. 4 (four) interviewed staff stated that there has been a recent group of children that has transitioned from the infant programs\342\200\231 toddler classroom into the preschool program younger 2\342\200\231s classroom. 4 (four) staff interviewed stated that these children are getting acclimated to a new environment/routine. 3 (three) staff interviewed stated there have been challenges in the classroom and that they have been working on it by observing the group of children, rearranging the classroom to fit the children\342\200\231s needs, and that staff are working with the children to adapt to the new routine and that it is getting better. 4 (four) staff interviewed stated that if a child did injure another child while in care that each family; the child who injured and the child who received the injury would receive a report detailing the incident without giving names of the children to keep it confidential. LPA received a written declaration from S4 with the strategies they have used while the Two\342\200\231s classrooms have been experiencing children transitioning in the classroom and out of the classroom. S4 stated that there has been ongoing support with additional staff to help support children to learn the new routine, and additional staff during transition time to support supervision, and they are documenting consistent behaviors into My Path to help with support. 4 (four) interviewed staff stated they have supported C1 with behaviors that need adult guidance by providing C1 with positive redirection, shadowing, and partnering with C1\342\200\231s parents. During LPAs\342\200\231 observations on 12/11/2025 LPA observed C1 at the tables with a group of kids engaged in activity. During transition to playground LPA observed S3 ask C1 to be line leader and to hold the clip board as they walked. C1 entered the playground with S3 and S3 stayed close enough to C1 to provide intervention if needed (shadowing). S4 stated that C1 is on the older side in the younger 2\342\200\231s classroom and will be transitioning out soon. Continue to page 4. Page 4 During records review, LPA obtained and reviewed a daily schedule, Child time family handbook that included topics on transitions and positive behavior support, reviewed current behavior plans, attendance log with names of the children who transitioned from infant programs toddler classroom into preschool 2\342\200\231s classroom, employee handbook that described performance and expectations for staff. LPA attempted to interview 4 parents, and 4 parents called were unable to interview. Based on LPA observations, interviews, and records review; the preponderance of evidence standard has not been met. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation of Staff did not prevent a child from harming other children in care did or did not happen; therefore, the allegation s is UNSUBSTANTIATED. Exit interview conducted and report was reviewed with Director America Lopez. The Director was informed that the \342\200\234Notice of Site Visit\342\200\235 must be posted on or adjacent to the door for 30 days. Failure to post will result in a Civil Penalty of a $100.00.
