Page 2 During the course of investigation, LPA Nelson and LPA Nguyen learned that on the day of the incident, there was one section of the corner fence were not secured, a child could push out and open wide gap enough to go through. The fence leads into a walkway, that leads to street. On 08/19/2021, Licensing office received a self-report Unusual Incident Report from licensee reporting, a 2 years old child wandered away from the facility without facility staff members acknowledge. The investigation was initiated on 08/24/2021 by LPA Jordann Nelson and continued on 09/24/2021 by LPA Tina Nguyen. LPA Nelson interviewed staffs, parents, and attempted to interview children on 08/31/2021. On 10/06/2021, LPA Nguyen conducted additional interviews with 5 staff members. On 08/24/21 LPA Nelson interviewed S1 who stated that it was C1\342\200\231s first day of school. S1 stated that while outside, S1 tried to encourage C1 to come over and play, but C1 would not move from the same spot. S1 then returned to the other students, this resulted in S1 not keeping direct supervision on C1, who was near corner fence. LPA Nguyen attempted to interview C1, but due to C1\342\200\231s age and limited speech, LPA was not able to qualify child. During the investigation, facility staff members confirmed the reporting party's statements regarding the child wandering away from the facility was accurate. The staff members interviewed, estimated that the C1 was missing for about 5 to 10 minutes. Staff #5 (S5) and Staff #6 (S6) indicated that the incident occurred on the first school day of for C1. Per S5 and S6, on the day of the incident at approximately 9:55 AM or 10 AM, S5 saw a couple that was carrying a child while waiting at the school door, S5 opened the school door, the couple gave C1 to S5. In the afternoon, the individual returned and provided contact information; the individual requested the contact information be given to the C1\342\200\231s parent. S5 indicated that the contact information was given to S5\342\200\231s manager who provided the information to the parent. On 10/06/2021, LPA Nguyen requested the video footage of the incident; S5 and S6 confirmed that the video was not available since the video recording is live, for parent viewing, not recording. Based the information obtained and interviews, the facility staff failed to provide adequate supervision resulting in a day care child wandering away from the facility. The preponderance of evidence standard has been met, therefore allegations: Child was left unattended; Staff did not provide adequate supervision are found to be substantiated. (Continue on page 3) Page 3 On 08/24/2021, during the case management, LPA Nelson cite the facility type A violation under California Code of Regulations, Title 22, Division 12 & Chapter 1, Article 6 Continuing Requirements 101229 (a) (1) Responsibility for Providing Care and Supervision for the same violation. Therefore, no citation is given for today inspection for Care and Supervision. During today\342\200\231s inspection, LPA Nguyen cited the facility type A violation under California Code of Regulations, Title 22, Division 12, Chapter 1, Article 07. Physical Environment 101238 (a) Buildings and Grounds. Please refer to attached 9099D for documentation of deficiency This report cites a Type A violation and shall be provided to parents/guardians of children currently in enrolled and to parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must sign Form LIC9224 to be kept in each child's file. Exit interview was conducted. Notice of Site Visit was posted during the visit. Licensee was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Licensee was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the Regional Manager to the address listed above.

This poses an immediate risk to the health and safety of the children in care.
