What the inspector wrote

An unannounced case management inspection was conducted on this date by Licensing Program Analyst (LPA), Cindy Nguyen in response to a self-reported incident dated 05/08/24. Present during today\342\200\231s inspection was the Director, Irene Guereca. Census was taken in individual classrooms. The overall census observed was 39 preschool children and 5 preschool staff members. A review of adult records indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. On 05/08/2024 an Unusual Incident Report was filed with the Department to self-report an incident that occurred on 05/07/2024. Assistant Director called to inform that a child, along with a group of parents and children, walked into the office and out the front entrance door. During the staff interview, all five staff interviewed stated they didn't observe Child #1 (C1) leaving the playground through the office. Staff #2 (S2) stated S2 had clocked out at 4:26pm and was in the office. At approximately five minutes later, S2 heard a knock at the office door, a witness brought C1 to S2 and stated, \342\200\234I am just returning C1, C1 got out in the front where the cars are.\342\200\235. LPA was able to interview the witness at the facility and the witness was able to show LPA where the child was found by the curb near the drop off and pick up zone. LPA measures an approximate 151 ft from the playground office door to where the child was found. LPA was also able to interview the district manager who stated she has viewed the video footage and the time the C1 left the playground office door was at 4:29pm and C1 was returned to the office by the witness at 4:32pm. The video footage was not available for LPA to view during today\342\200\231s inspection. Based on the information gathered from the self-reported unusual incident report, interviews with five staff members, the witness, the district manager, statements from the five staff and a physical plant inspection. It was determined C1 walked into the office from the playground and out the front entrance door to the curb near the drop off and pick up zone. A civil penalty of $500 was assessed today. LPA informed Director, Irene Guereca that this report dated 05/15/2024 document a Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. LPA also informed the Director, Irene Guereca to provide a copy of this licensing report dated 05/15/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview was conducted with Director, Irene Guereca. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above. End of Report.

(1) No child shall be left without the supervision of a teacher at any time, Supervision shall include visual observation. This requirement is not met as evidenced by: Based on LPA interviews and record review, the facility staff failed to provide supervision to C1. C1 was able exit the facility, out the front entrance door to the curb near the drop off and pick up zone an approximate 151 ft. This poses an immediate Health and Safety risk to the children in care.
