LPAs Dianna Valdez Santana and Aidee Nunez conducted a case management visit to ensure licensee posted the Notice of Site Visit and Licensing report documenting a type A deficiency. LPAs also wanted to verify if parents received a copy of the report and had signed the Acknowledgement of Receipt of Licensing Reports (LIC 9224). Upon arrival, LPAs were met by Director, Noreen Begole. LPAs toured the facility and census was taken, there were 25 children in care being supervised by three staff. A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Director contacted LPA Valdez Santana to inform her that the owner instructed her to wait and not to give parents a copy of the report and sign the LIC 9224 forms until they received the results of their appeal. LPA reminded the Director that according to Regulations, the facility must comply with the Plan of Corrections which includes posting the Type A Licensing Report, giving parents a copy of the report and have each parent sign the LIC 9224. Director stated she would relay the information to the owner. Upon arrival LPAs observed that the Notice of Site Visit was posted. The Licensing report citing the Type A deficiency that was issued on 1/27/23 was not posted. LPA Valdez Santana asked Director if she gave parents a copy of the report and if she can show LPA the signed LIC 9224 forms. Director was only able to show her two signed forms from one family that were not dated. Director stated she wanted to comply but was conflicted by the direction of the owner. She said she would start giving them to parents. LPAs also reminded Director that signed LIC 9224 forms must be in the children\342\200\231s individual files. Page 1 of 2 Based on LPAs records reviews and observations, the following violations were observed and are being cited in accordance with Health and Safety Sections 1596.8595 (a)(1) Posting Licensing Report by Child Care Facility and Health and Safety section 1596.8595(c)(1) Report to be provided to parents or guardians. See attached LIC 809D. An Inspection and exit interview was conducted with Director. The report was reviewed and discussed. Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058 ) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. The facility representative was informed that the \342\200\234Notice of Site Visit\342\200\235 must be posted for 30 consecutive days. The \342\200\234Notice of Site Visit\342\200\235 must be posted on or adjacent to the door. Failure to post will result in Civil Penalties of $100.00. Page 2 of 2.
