Based on interview and record review, the licensee did not comply with the section cited above in director stated she doesn't recall having the drinking water LEAD testing. LPA checked website & no record found. This poses a potential health, safety or personal rights risk to persons in care.

Based on interview and record review, the licensee did not comply with the section cited above in Staff #3 (S#3) missing immunization: flu, pertussis, and measles, which poses/posed a potential health, safety or personal rights risk to persons in care.

PRESCHOOL PROGRAM WITH TODDLER COMPONENT

101216.4 Preschool Program with Toddler Component (a) Licensees serving preschool-age...(2) The toddler program shall be conducted in areas physically separate...This requirement is not met as evidence. Based on observation and interview, facility failed to ensure to keep physically seperate programs for Preschool and Toddler option. LPA observed child#1 was commingling with five preschool children in the daycare room. This poses an immediate Health and Safety risk to the children in care.

1596.7995(a) (1) Person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles...This requirement is not met as evidence. Based on LPA interview and record review, S4, did not have proof of immunization records on file. This poses a potential risk to the children in care.

ARTICLE 2. Administration of Child Day Care Licensing

1596.8662(b)(1) Training for Mandated Reporter: On or before March 30, 2018, a person who, on January 1, 2018, ... date on which he or she completed the initial mandated reporter training. This requirment is not met as evidence by: Based on interviews and record reviews, proof of completion of required mandated reporter training for S4 was not available for review during today's inspection. This poses a potential safety risk to children in care.

H &S 101429(a)(1) )(1) Each licensed child day care facility shall post a copy of any licensing report pertaining to the facility that documents either a facility visit or a complaint investigation that results in a citation for a violation that, if not corrected, will create a direct and immediate risk to the health, safety, or personal rights of children in care. The licensing report provided by the department shall be posted immediately upon receipt...shall remain posted for 30 consecutive days... (3) Failure to comply with paragraph (1) shall result in an immediate civil penalty of one hundred dollars ($100). This requirement was not met as evidenced by facility failing to post Type A report.

ARTICLE 2. Administration of Child Day Care Licensing

H&S 1596.8595(c)(1) Posting licensing report by child care facility or home..(c)(1) A licensed child day care facility shall provide to the parents or guardians of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights... This requirement is not met as evidence by: Based on LPAs records reviews, interviews, and observation, it was discovered that licensee failed to give parents copies of the licensing report that documents any Type A…. and the LIC 9224 Acknowledgment of Receipt of Licensing Report to the parents of the children in care. This poses a potential risk to the health of children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. The above was not met as evidenced by:Based on interviews with staff, LPA determined that a child #1 was left by staff unsupervised in the facility parking lot, for approximately 2 minutes. This poses an immediate threat to the child/children's health, safety, and personal rights.

1596.8662(4)(b)(1) On or before March 30, 2018, a person who, ..licensed child care provider, administrator, ... mandated reporter training provided pursuant to paragraphs (2) and (3) of ... mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.This requirement is not meet: Base on record review, Staff #1 (S1)'s Mandated Reporter training is expired 09/20/2018; Staff #2 (S2)'s Mandated Reporter training is expired 09/13/2018. This poses a potential Health and Safety risk to the children in care.
