What the inspector wrote

On 10/18/2022 LPA Duron and LPM Ho interviewed 6 staff members and no disclosures were made by any staff members regarding the above allegations. All interviewed staff members denied witnessing any staff handle day care children in a rough manner. Staff members denied witnessing any staff yelling at day care children. Staff confirmed bleach water was used to disinfect toys due to hand, foot and mouth disease, but the disinfectants were never accessible to children in care. Staff members denied staff not providing adequate meal service to children, staff stated children have plenty of food to eat, and never state they are still hungry. On 10/18/2022, LPA Duron interviewed 3 children, no disclosures were made by any children. All interviewed children stated they like their teachers. On 10/28/2022 LPA Duron contacted four parents by phone and was able to interview two parents. All interviewed parents stated they did not have any concern with facility. Based on the information gathered from LPAs’ interviews, observation, and reviewing records, there is insufficient evidence to corroborate the allegations of staff handling children in rough manner, staff yelling at children in care, staff leaving disinfectants accessible to children in care, or staff not providing adequate meal service to children. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day care facility, therefore the allegations are unsubstantiated. An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department. Page 2 of 2. End of Report. On 10/18/2022, LPA Duron and LPM Ho interviewed 5 staff members. During the interview, Staff #1 ( S1) stated about a month ago, when outside eating lunch, S1 went inside the kitchen to get something, Child #1 ( C1) walked in behind S1. S1 didn’t realize C1 came into the kitchen. S1 came back out and closed the kitchen door. S1 then heard whimpering. Both S1 and S2 saw C1 at the kitchen window and S2 went in the kitchen to get C1. S1 stated C1 was left in the kitchen for about 30 seconds. S2 also disclosed witnessing C1 was left in the kitchen for less than a minute . S2 stated about 3 weeks ago, S1 went into the kitchen to get something and closed the door behind S1 . S2 heard crying and saw C1 was in the kitchen by the window crying. S3 just came back from break and was outside with S1 and S2 during lunch time . S3 heard crying. S3 saw S2 opened the kitchen door and C1 was inside the kitchen crying. S3 stated C1 was left in the kitchen for about 1 minute. During the investigation, LPA Duron and LPM Ho interviewed 3 children, no disclosures were made by any children. LPA Duron contacted four parents by phone and was able to interview two parents. All interviewed parents stated they did not have any concern with facility. Based on information gathered from LPA’s interviews, the preponderance of evidence standard has been met, therefore the above allegation s is found to be Substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101229(a)(1) Responsibility for Providing Care and Supervision is being cited on the attached LIC 9099D. Please refer to attached 9099D for documentation of deficiencies. LPA Patricia Duron informed Director, Krista Hoadley that this report date 12/21/22 document(s) one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. LPA Patricia Duron informed the Director, Krista Hoadley to provide a copy of this licensing report dated 12/21/22 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. An exit interview was completed. The report was reviewed and discussed. Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. This poses an immediate safety risk to the children in care.
