Based on record review, the licensee did not comply with the section cited above in one out of two staff personnal records did not have Pertusis immunization on file for review which poses a potential health, safety or personal rights risk to persons in care.

DISASTER AND MASS CASUALTY PLAN

Based on observation and records review, the licensee did not comply with the section cited above in 1 out of 1 disaster drill, which poses/posed a potential health, safety or personal rights risk to persons in care. The last drill was documented on 12/2022.

DRINKING WATER

Based on observation and records review, the licensee did not comply with the section cited above in 1 out of 1 lead test for water outlets, which poses/posed a potential health, safety or personal rights risk to persons in care. One water outlet in the infant room has not been tested for lead.

PERSONAL RIGHTS

101223 Personal Rights(a) The licensee shall ensure that each child is accorded the following personal rights:(2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidence by interviews and observation. The facility representative did not require all staff to wear a mask while indoors at the facility.

Health and Safety Code Section 1596.8897 reads:(2) Engaged in conduct which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility, or the people of the State of California. This requirement was not met as evidence by observations and interviews conducted. The director did not comply with the California Department of Public Health (CDPH) public health order to require all individuals (excluding infants in care) , regardless of vaccination status to wear mask indoors in child care settings.

PERSONNEL REQUIREMENTS

At least one staff member who is trained in pediatric cardiopulmonary resuscitation and pediatric first aid pursuant to Health and Safety Code Section 1596.866 shall be present when children are at the child care center or offsite for center activities. This section was not met as evidenced by reviewing 5 staffs' files. Four staff's CPR and 1st aid cards were expired on 3/5/21 however one staff's card from preschool program will expire on 8/21 but the staff person is not scheduled to be in the facility from opening to closing. The facility operates 7am to 6 pm and the staff with current CPR card works from 8 am to 5:30 pm. The director has scheduled a training for August 2021. This is a potential risk to the health and safety of children in care.
