What the inspector wrote

On 12/28/2020, our office received a complaint and complainant reported that a staff member yell at a child and said “get up right now” so other child can sit. LPA Nguyen conducted the interview with five staff members. A staff member disclosed witnessing Staff 2 (S2) raises S2 voice when children do not listen to S2’s directions. It is loud and can hurt the children and staff's ears when S2 raises S2 voice. This staff member also confirmed witnessing S2 yelled at a child while the child was sitting on a chair and said “get up right now” so another child can sit. LPA Nguyen contacted six parents and was able to interview one parent. The interviewed parent stated they did not have any concern or issue with the facility. LPA Nguyen conducted interviews with 6 children and able to interview 5 children. No disclosures were made by children. All interviewed children disclosed they like going to the school and all the teachers are nice and friendly. Based on the gathered information from interviewing staff, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division & Chapter 1, 101223 Personal Rights (a)(3) is being cited on the attached LIC9099D. This report cites a Type A violation and shall be provided to parents/guardians of children currently in enrolled and to parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must sign Form LIC9224 to be kept in each child's file. The Notice of Site Visit was posted. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) will be provided through email and their signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report. All appeals must be in writing and received by the licensing office within 15 business days. On 12/28/2020, our office received a complaint and complainant reported that a staff member grabbed a child’s arm hard when picking up a child; a staff member aggressively flipped a child over when the child was lying down during nap time; and a staff member spanked a child. LPA Nguyen conducted interview with five staff members. No disclosures were made by staff members to LPA Nguyen. All interviewed staff stated if the children did not want to nap, the staff members will ask the child to lay down on their bed and relax their body. Interviewed staff members also stated if the children did not listen to the teachers, the staff members will redirect the children to other activities. All interviewed staff denied of witnessing any staff member grabbing any child’s arm hard when picking up a child or aggressively flipping a child over when the child was lying down during nap time or any staff member spanking any child. LPA Nguyen contacted six parents and was able to interview one parent. The interviewed parent stated they did not have any concern or issue with the facility. LPA Nguyen conducted interviews with 6 children and able to interview 5 children. No disclosures were made by children. All interviewed children disclosed they like going to the school and all the teachers are nice and friendly. Based on the interviews conducted and reviewing records, there is insufficient evidence to corroborate the allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged staff handles day care children in a rough manner; Staff hit day care child did or did not occur, therefore the allegations are UNSUBSTANTIATED. Exit interview was conducted. The Notice of Site Visit was not posted due to tele-investigation Covide-19 State of Emergency. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) will be provided through email and their signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report.
