What the inspector wrote

During the initial inspection dated 5/3/23 LPA Duron interviewed staff, 2 out of 5 staff stated they had witnessed , On April 20, 2023, Staff #6 (S6) was holding a broom in their hand and stood over child in care as child laid on the grass. Director disclosed management reviewed the video footage which was available for 48 hours only and observed S6 had a broom in their hand as S6 was standing over the child who was laying on the grass. Management immediately terminated S6 from employment and reported the incident to Licensing office. S1 disclosed witnessing S6 tapping a child with the broom on the child’s head and said S6 was going to smash the broom over the child head. S1 also said S6 would hurt the child with the broom. The child was crying. No staff disclosed witnessing any staff pulling the children’s ears. LPA Duron interviewed 4 parents. 4 out of 4 parents did not have any concern with facility. Based on information gathered from LPA’s interviews and reviewing records, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101223(a)(1) Personal Rights and 101223(a)(3) Personal Rights. Please refer to attached 9099D for documentation of deficiencies. LPA Patricia Duron informed Director that this report date 7/14/23 document(s) two Type A citation which shall be posted for 30 consecutive days as there are immediate risk(s) to the health, safety, or personal rights of children in care. LPA Patricia Duron informed the Director, Mary Joy Hilsabeck to provide a copy of this licensing report dated 7/14/23 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Page 2 of 3 An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. Deficiencies were discussed. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department. The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door. Page 3 of 3. End of Report.

This requirement is not met as evidence by: Based on LPA’s interview, S1 disclosed witnessing S6 tapping child with the broom on the child’s head and S6 was going to smash the broom over the child’s head and would hurt the child with the broom. The child was crying. This action poses an immediate risk to the health and safety to the child in care.
