What the inspector wrote

(Page 2 of Report) During investigation, LPA Tran interviewed 5 staff members and 3 parents and reviewed of staff’s training records, staff schedule and face-to-name sheets. During staff interviews, 5 out of 5 staff denied that they have or have witnessed any staff at the facility, hit day care children, yelled at day care children, handled day care children in a rough manner, and left day care child unattended. One out of 5 interviewed staff did observed child #1 (C1) had a rash on the forehead when C1 woke up from nap and instructed the substitute teacher to apply ice. According to this staff, child appeared to be fine and was picked up by parents with no visible mark on his face. Staff also did inform the parents about the observation and the action taken. During the investigation, LPA Tran did not interview any children since they were all under 2 years of age and were not verbal to be interviewed. During parents' interviews, LPA contacted 5 parents and was able to interview 3 parents. 3 out of 3 interviewed parents have no concerns related to the allegations. They are all happy with the school's services for their children and keeping the communication open. During record reviews, LPA Tran reviewed staff's schedules, face-to-name sheets, and staff training records. The records shown that the facility met teacher-child ratio on the day of the incident and verified all the teachers who worked in the Toddler B classroom on 04/11/2022. Staff's training records shown that staff were trained on Children's Safety, Supervision and Positive Behaviors Support. Based on LPA's interviews with 5 staffs and 3 parents and record reviews of staff training, schedules and face-to-name sheets, there is insufficient evidence to corroborate the allegations that staff hit day care children, staff yells at day care children, staff handled day care children in a rough manner, day care child sustained unexplained injury, day care child was left unattended on changing table. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove that staff hit day care children, staff yells at day care children, staff handled day care children in a rough manner, day care child sustained unexplained injury, day care child was left unattended on changing table did or did not occur, therefore the allegations that staff hit day care children, staff yells at day care children, staff handled day care children in a rough manner, day care child sustained unexplained injury, day care child was left unattended on changing table are unsubstantiated. Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Director Andrea Silva.
