INFANT CARE FOOD SERVICE

101427 Infant Care Food Service (j) Bottles, dishes, and containers of food brought by the infant's authorized representative shall be labeled with the infant's name and the current date.This requirement is not met as evidenced by Based on the information gathered from the self-reported unusual incident report, observations, and interviews with three staff, it was determined that S1 fed the wrong bottle of breast milk to Child #1 (C1) that belonged to Child #2 which poses a potential health, safety or personal rights risk to the persons in care.

101429(2)(A) Responsibility for Providing Care and Supervision (2)Sleeping infant(s) shall be directly observed by sight and sound at all times.(A) This shall include when the infants are going to sleep, are sleeping...This requirement is not being met as evidenced by: Based on LPAs observation and interview, 2 teachers with 6 infants. 1 staff sitting on the floor in carpet area and1 teacher in kitchen. LPA asked who was supervising the infant asleep in the napping room. Staff stated they are trying but no one is in the napping room supervising the infant.

FIXTURES, FURNITURE, EQUIPMENT AND SUPPLIES

Based on observation, the licensee did not comply with the section cited above in both rooms Toddler A &B are bathrooms are used as storage. LPA observed large trash bins, brooms, and empty boxes, children in Toddler B use the bathroom sink to wash their hands which poses/posed a potential health, safety or personal rights risk to persons in care.

INFANT CARE CENTER FIXTURES, FURNITURE, EQUIPMENT

Based on observation, the licensee did not comply with the section cited above in room Toddler B did not have a working sink next to the changing table, staff have to walk to the restroom which is about 6 feet away to use the sink that is in the bathroom which poses/posed a potential health, safety or personal rights risk to persons in care.

POSTING OF LICENSE

Based on observation, the licensee did not comply with the section cited above in all posting requirements were not posted on the day of the inspection which poses/posed a potential health, safety or personal rights risk to persons in care.

ARTICLE 2. Administration of Child Day Care Licensing

Based on record review, the licensee did not comply with the section cited above in 03 out of 08 persons which poses/posed a potential health, safety or personal rights risk to persons in care. S1, S2 and S7 did not have a current mandated reporter certification.

PERSONNEL REQUIREMENTS

Based on record review the licensee did not comply with the section cited above in 01 out of 01 persons which poses/posed a potential health, safety or personal rights risk to persons in care.S5 has the health screen in file incomplete. This poses a potential risk to the children in care.

Based on record review, the licensee did not comply with the section cited above in 01 out of 01 persons which poses/posed a potential health, safety or personal rights risk to persons in care. Staff #2 did not have this requirement.

INFANT CARE CENTER FIXTURES, FURNITURE, EQUIPMENT

Based on observation, the licensee did not comply with the section cited above in 01 out of 01 objects which poses/posed a potential health, safety or personal rights risk to persons in care. LPA observed that in class Toddler A does not have an arms length sink within reach of the infants changing table which poses a potential risk to the children in care

Staff-Infant RatioThere shall be a ratio of one teacher for every four infants in attendance. This requirement was not met as evidenced by LPAs observations from 7:50 am until 8:07 am. At 7:50 LPA met with Lead Teacher Elizabeth Cuatecontzi who was providing care in Infant room. LPA viewed 5 infants up to 12 months old in care. LPA also viewed one aide providing care. At 7:58am LPA entered Toddler Room A, LPA viewed 1 fully qualified teacher(S2), one aide (S3) and cook(S4). LPA viewed 13 infants in care.At 8:05 am 14th child was admitted. At 8:07am Ms. Cuatecontzi arrived to provide support for staffing ratio. This poses an immediate health and safety risk and or a personal rights risk to children in care.

Teacher-Child Ratio101216.3(e)Each licensee shall maintain an up-to-date list of qualified teacher substitutes as defined in Section 101152q.(1).Substitutes on this list shall be called immediately in case of emergency or illness to meet the teacher-child ratios required by this chapter. This requirement is not being as evidenced by: Based on LPA observation facility was short staffed for several hourswhich lead to management caring for children for during LPA's visit.

Teacher-Child Ratio 101216.3(d) The licensee may include the child care center director in the teacher-child ratio when the director is actually engaged in teaching a group of children. This requirement is not being met as evidenced by: Based on LPA observation and record review facility was short staffed so management were caring for children while performing office duties until afternoon staff clocked in to relieve them.

101700.3 California Lead Action Level at Child Care Centers (b) Testing results with fractional ppb readings of 5.0 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. Based on lab report analysis water from outlet C bathroom sink located in "Toddler A" tested on 8/16/22 had a level of 8.15 ppb (parts per billion) . This faucet sample indicates levels of lead in exceedance.
