What the inspector wrote

On 03/09/2023, Licensing Program Analyst (LPA) Romy Castanon conducted a Case Management due to deficiencies observed during today's inspection. LPA arrived at 9:15am and was greeted by the facility’s food specialist at the gate and lead into the office. LPA placed down belongings and followed staff to the infant classroom where LPA briefly met with Director Andrea Silva to explain the reason for the visit. Director was unable to escort LPA to conduct census because she was in the infant classroom with another teacher caring for 8 infants. During a self-guided tour, Assistant Director (AD) Aimee Valentin joined LPA. LPA observed repair work being conducted in Toddler Classroom A and B. The facility was installing new fire alarm system. LPA asked AD where the children were being relocated for the day. The children were playing in the outdoor side yard. The play structure was taped off, LPA will address that issue during an office meeting. LPA counted 17 children and 5 staff members, including the food specialist who assisted LPA at the entrance of the facility minutes prior. During LPA’s observation, the food specialist needed to begin preparing snack and needed to be relieved to return to the kitchen. AD removed a female child from the group and was placed in the arms of the Director who was conducting an employment interview. During LPA’s tour of the facility, LPA observed two diaper changing tables that had a broken cabinet door and unsanitary changing pads. The infant room’s changing table cabinets did not have a child proof lock. All infant diaper rash creams that state “keep out of reach of children” were located on the bottom shelf of that changing table. LPA returned to the office after conducting census for the facility’s preschool license. AD was now caring for the female child as the Director was now assisting with providing staff their breaks. LPA observed a family arrive for a tour just before 10:45am. AD conducted the tour holding the female child. The Director was now caring for a male child that had arrived at the same time. The facility was now out of ratio by two (2) children. Continue to page 2 Page 2 LPA reviewed the infant license sign in/out sheets and the staff attendance for the day. The last two children were signed in at 9:32 am and 10:46 am. The infant license classrooms were in ratio compliance at 12:00 pm when an infant staff arrived. For about three (3) hours that LPA was on campus, there were not enough staff members for the number of children in attendance. Based on LPA’s observation and record review, the facility is being cited in accordance with California Code of Regulations, Title 22, Division 12, Section 101216.3 Teacher-Child Ratio subsections (d) and (e) and 101439 (h)(3) Infant Care Center Fixtures, Furniture, Equipment and Supplies. Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. Licensee shall have LIC9224 (Acknowledgement of Receipt) signed and kept in each child's file. Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days.
