What the inspector wrote

Licensing Program Analyst (LPA) P Rivas conducted an unannounced plan of correction visit for the citations issued during the visit conducted on 03/09/2023. Upon arrival, At 7:50 LPA met with Lead Teacher Elizabeth C uatacontzi who was providing care in Infant room. LPA viewed 5 infants up to 12 months old in care. LPA also viewed one Aide(staff#1) providing care. At 7:58am LPA entered Toddler Room A, LPA viewed 1 fully qualified teacher(S2), one aide (S3) and cook(S4). LPA viewed 13 infants in care. At 8:05 am 14th child was admitted. At 8:07 am Ms. Cuatecontzi arrived to provide support for staffing ratio. Ms. Cuatacontzi stated another staff arrived in infant room 1.. The facility was out of compliance based on LPAs observation from 7:58am until 8:07 am. Based on LPAs observations A citation is being issued under 101416.5 (b)Staff-Infant Ratio There shall be a ratio of one teacher for every four infants in attendance. LPA Castanon arrived during visit to assist LPA Rivas. A review of the facility personnel report summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or excemptions. Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated . The following deficiency was cleared; 101216.3 (e)Teacher-Child Ratio . LPAs were advised that Director has hired two staff, is now using a Temporary Agency to add to substitute list. LPAs viewed one new staff file and also 1 staff from temporary agency. cont. on page 809c page 2 LPA was unable to clear citations issued under 101216.3 (d)Teacher-Child Ratio . However, citation is being issued under 101416.5(b) Staff-Infant Ratio Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. Per Section 1596.8595 (a)Posting licensing report by child care facility or home; duration of posting; civil penalty for failure to comply; reports to be provided to parents or guardian of each child receiving services -The licensing report provided by the department shall be posted immediately upon receipt, adjacent to the postings required pursuant to Section 1596.817 and on, or immediately adjacent to, the interior side of the main door to the facility and shall remain posted for 30 consecutive days. Licensee shall have LIC9224 (Acknowledgement of Receipt) signed and kept in each child's file.The Notice of Site Visit was posted and discussed it must be posted as required by H & S Code Sec. 1596.817. Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.00. Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. Exit interview conducted and report was reviewed with Director Andrea Silva. End of Report

At 7:58am LPA entered Toddler Room A, LPA viewed 1 fully qualified teacher(S2), one aide (S3) and cook(S4). LPA viewed 13 infants in care.At 8:05 am 14th child was admitted. At 8:07am Ms. Cuatecontzi arrived to provide support for staffing ratio. This poses an immediate health and safety risk and or a personal rights risk to children in care.
