What the inspector wrote

LPA Odom initiated this investigation on 06/08/21, Odom’s investigation included interviews with one staff and the complainant party. The Department received a complaint on 06/03/21 alleging staff left a day-care child crying, unattended for over 45 minutes on a highchair. A second complaint allegation was received alleging the child’s needs were not met, as the child was observed to be dirty and with a soiled diaper during pick up. LPA Villa took over the investigation on 07/22/21, during this inspection, LPA Villa interviewed four staff. Children were not interviewed as children are non-verbal. During the interviews staff stated that highchairs are only used for feedings. Staff stated if a child is found crying while on a highchair they are removed immediately to console the child. Staff denied observing any day-care child, crying and unattended for long periods of time on a highchair. During this complaint inspection LPA Villa obtained screen shots of TadPoles, an application which is used to log in diaper changing activities as stated by Assistant Director Amber Prinzi. Three parent interviews were conducted, there were no disclosures made during parent interviews related to the complaint allegations. LPA Villa & Odom made several attempts to obtain records from the complainant party. The complainant party was unreachable and such records were not obtained. Information obtained during Staff interviews state that diapers are changed every two hours. There is also a diaper schedule that ensures this activity is taking place in a timely manner as per Amber Prinzi. Upon diaper changing the staff enters the activity into the TadPole Pro application. This application notifies the parents of such activity. During staff interviews, staff stated they had recently received training on personal rights from our Childcare Advocate, Susan. Based on LPA Villa & Odom’s facility inspection, observations, interviews conducted with complainant party, director, 4 staff, and records reviewed it was determined there was insufficient evidence that Staff left a crying child unattended on a high chair for 45 minutes or that a daycare child was dirty and with a soiled diaper upon pick up. The preponderance of evidence was not met. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated. There were no citations cited during this complaint investigation. An Exit interview was conducted with Director, Nicole Carreon & Assistant Director, Amber Prinzi. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
