What the inspector wrote

(page two) Regarding allegation (1) Teacher is handling a child in a rough manner. LPA conducted classroom observations on 7/8/2025 and did not observe children in care handled in a rough manner. During interviews five (5) out of (5) stated that they have not seen or heard of children handled in a rough manner. LPA received and reviewed documentation of orientation training videos to ensure children’s personal rights. Parents interviewed did not disclose any information to support the allegation. The Orange County Regional Child Care Licensing Office investigated allegations: (1) Teacher is handling a child in a rough manner is found to be UNSUBSTANTIATED. Based on information gathered from LPA’s interviews and record reviews, although the allegations may have happened or are valid, there was not a preponderance of evidence to prove the alleged (1) Teacher is handling a child in a rough manner did or did not occur; therefore, the listed allegations are found to be UNSTUBSTAINTIATED. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Director, Nicole Carreon. (end of report) (page two) Regarding allegation (1) Teacher is spraying child in the face with a spray bottle to keep them awake. During the interview, Staff #4 (S4) admitted that S4 sprayed water from the spray bottle on Child #1 (C1)’s face to keep C1 awake prior to naptime. S4 stated a former staff member trained S4 to do so. Staff #3 (S3) stated that they witnessed S4 spray water at C1 to keep C1 awake before naptime started. Three (3) out of five (5) interviewed staff have heard or witnessed C1 being sprayed with water on C1’s face to be kept awake. This is a violation of Personal Rights regulation. Regarding allegation (2) Teacher left child strapped and asleep in a chair. During record review, LPA reviewed provided facility camera footage on 07/03/2025 and observed C1 had fallen asleep at the table while eating. C1 was not moved to the napping equipment for more than ten (10) minutes. LPA also reviewed copies of Employee warning notices for Staff #3 (S3) and Staff #4 (S4) from the facility, in which, the notices stated a final warning for S3 and S4 due to the incident of C1 falling asleep and S3 and S4 did not place C1 in cot for longer than a period of ten minutes. Four (4) out of five (5) interviewed staff stated that they observed C1 fell asleep in a chair for a period of time before being moved into napping area. This is a violation of Infant Care Activities regulation. The Orange County Regional Child Care Licensing Office investigated the allegations: (1) Teacher is spraying child in the face with a spray bottle to keep them awake, and (2) Teacher left child strapped and asleep in a chair. Based on information gathered from LPA’s interviews and record reviews, the preponderance of evidence standard has been met; therefore, the allegations are found to be SUBSTANTIATED. California Code of Regulations (CCR) Title 22, Division 12 Section 101223(a)(3) Personal Rights and 101430(a)(3)(E) Infant Care Activities were cited on the attached 9099D. Violation of CCR Section 101430(a)(3)(E) Infant Care Activities was previously cited on 03/25/2025. During the visit, facility is cited the same section of CCR. This is a repeated violation within 12 months, therefore, a civil penalty for repeated violations was issued. (page three) LPA Meza informed Director, Loretta Munoz that this report dated 09/05/2025 documents Type A citations which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. LPA Meza also informed the Director, Loretta Munoz to provide a copy of this licensing report dated 09/05/25 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and report was reviewed with the Director, Nicole Carreon. A notice of site visit was given and must remain posted for 30 days. (end of report)

Based on interviews three (3) out of five (5) staff members stated that they have heard or witnessed C1 being sprayed with water on C1 face to keep C1 awake. This poses an immediate health, safety or personal rights risk to persons in care.

    101430(a)(3)(E) Infant Care Activities violation. If an infant falls asleep before being placed in a crib, staff shall move the infant to a crib as soon as possible. Four (4) out of five (5) staff interviewed stated that they observed a child asleep in a chair. LPA obtained camera footage of C1 asleep in chair for more than 10 minutes and documentation of warning for S3 & S4. This poses an immediate health, safety or personal rights risk to persons in care.
