What the inspector wrote

Page 1 of 2 Licensing Program Analyst (LPA), Mahnaz (Nancy) Malek conducted an onsite case management inspection for the purpose of checking into an incident that the facility self reported to our office on 3/1//2024. LPA met with director, Jaimee Roush. LPA took census. There were a total of 28 infants and toddlers and toddler option children from Toddler Option Component with 8 staff in rooms # 1, 4, 5 and outside. Room 3 was not in use. According to the self incident report, an allegation was reported to the facility management that 23 months old child went home with bruises. It was also reported that it was observed staff # 1 pushed hands away from a book that 23 months old child was holding. The incident happened on 2/25/2024. A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Today LPA interviewed the director, assistant director, staff # 1, staff # 2, and staff # 3 who were working with child # 1 during child's attendance and the incident. LPA reviewed a video footage dated 2/25/2024 regarding the reported incident. LPA observed the 23 months old child brought a piece of Montessori material to staff # 1 while holding it. Staff # 1 pulled out the piece of material out of the child's hand inappropriately in an unkind way. Staff # 1 put away the material. LPA interviewed staff # 1 who stated child took a piece of material that was not supposed to be engaged with for that time of the day. Staff # 1 took it away from the child and put it away. Staff # 1, 2, and 3 denied child # 1 got bruises at school. They said they would observe children when they fall to make sure they don't have any scratches or bruises. If they do, they will prepare ouch report for parent. Continued on page 2 Page 2 of 2 Children were not being interviewed due to their age being too young. Based on the interviews with 5 staff, and reviewing the video footage of the incident dated 2/25/2024 the behavior of staff # 1 was inappropriate and unkind towards child # 1. In the areas that were evaluated, the following deficiency was observed of the California Code of Regulations, Title 22, Division 12 on this inspection.(Personal Rights- Section 101223(a)(1). Please refer to LIC 809D for details of deficiency. A notice of site visit was given to director, Jaimee Roush and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to post will result in Civil Penalties of $100.00. Exit interview conducted and report was reviewed with the director, Jaimee Roush. End of report

This is potential risk to the health and safety and personal rights of children in care.
