What the inspector wrote

Page 2 The complainant alleged staff handled a child in a rough manner. According to the complainant, heard Child 1 (C1) crying very loud coming from the preschool classroom and observed C1 holding her wrist. On 3/22/23 and 5/9/23, LPA interviewed 7 staff including the director. 2 staff stated heard a C1 cry from the preschool classroom and followed by a loud boom which sounded like someone slammed the chair on the ground. The 2 staff did not visually witness the incident; however, they saw C1 holding on to her wrist. Staff 5 stated director informed staff 5 an incident was reported to her by S1 regarding C1. According to the director, there was no incident report regarding C1. There were no disclosures from the 5 staff interviewed. According to the Director, there was no incident reported regarding C1, due to an injury. On 4/26/23, LPA called 10 parents and interviewed 6 of the 10 parents. There were no disclosures made from the 6 parents interviewed. LPA did not receive a return call from the 4 parents. On 5/19/23, LPA interviewed 6 preschool children. There was no disclosure made from the 6 preschool children. Based on interviews conducted, the complaint alleging the staff handled a child in a rough manner is found to be unsubstantiated. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. The complainant alleged staff yelled at child. On 3/22/23, 5/9/23, LPA interviewed 7 staff including the director. Director stated she provided training to the staff since the last incident/complaint and have not had any complaint from staff and have not witnessed staff yell at children. According to S5 and S6, this was an ongoing pattern following the previous complaint regarding S1. S1 denies yelling at children. S3 and S7 stated have not witnessed staff yell at children since last incident. There was no disclosure from the 2 of 7 staff interviewed. On 4/26/23, LPA called 10 parents and interviewed 6 of the 10 parents. There were no disclosures made from the 6 parents interviewed. LPA did not receive a return call from the 4 parents. Page 3 On 5/19/23, LPA interviewed 6 preschool children. There was no disclosure made from the 6 preschool children. Based on interviews conducted, the complaint alleging the staff yelled at child is found to be unsubstantiated. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. The complainant alleged child(ren) were not accorded dignity in personal relationships with staff. The complainant stated Staff 1 does not treat children with respect. According to the complaint, due to previous incidents with S1’s behavior towards children is a follow up as this is a continued pattern of behavior. On 3/22/23 and 5/9/23, LPA interviewed 7 staff including the director. According to Director, due from the previous incident/complaint a training was held to all staff on how to better handle children. Director stated spoke with S1 and have gotten better on handling children. S3 and S7 stated S1 does not treat children with respect as S1 yells and handle them in a rough manner. S3 and S7 stated since the last incident, have not observed S1 handle or yell at children. S1 denies yelling at children and handle them in a rough manner. There were no disclosures from the other staff members. On 4/26/23, LPA called 10 parents and interviewed 6 of the 10 parents. There were no disclosures made from the 6 parents interviewed. LPA did not receive a return call from the 4 parents. On 5/19/23, LPA interviewed 6 preschool children. There was no disclosure made from the 6 preschool children. Based on interviews conducted, the complainant alleged child(ren) were not accorded dignity in personal relationships with staff is found to be unsubstantiated. Page 4 The complainant alleged the Director does not report unusual incidents to Licensing. According to the complainant, there were 2 incidents of children sustaining injuries and there was incident of lice outbreak. However, the complaint does not recall the dates of these incidents. On 3/22/23 and 5/9/23, LPA interviewed 7 staff including the director. 1 of 7 staff stated an incident with 2 children on different times sustained an injury and were not reported to Licensing. According to the director, unusual incidents reports are reported to licensing and to the parents. The 2 incidents regarding the 2 children on separate times were reported to licensing. According to Director, in March 2023, there was 1 child in care who had lice and was sent home. Director stated the sibling who also attend the preschool developed lice one month after. Director stated, did not report the incident based on her understanding of 3 or less cases were not reportable. LPA conducted a file review and based on the 2 incidents sustaining injuries were reported to licensing by the director on 11/10/21 and 4/8/22. According to the Director, the 2 children who had lice were on separate time period and was not reported to Licensing. On 4/26/23, LPA called 10 parents and interviewed 6 of the 10 parents. There were no disclosures made from the 6 parents interviewed. LPA did not receive a return call from the 4 parents. Based on interviews conducted and record review, the complaint alleging the Director does not report unusual incidents to licensing is found to be unsubstantiated. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. Exit interview was conducted. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights.
