Page 2 During the investigation LPA interviewed five staff, interviewed three parents, took pictures and reviewed video footage. Reporting Party (RP) alleges Facility is operating out of ratio. RP stated, on 10/16/2024, RP witnessed in the morning there were 2 teachers supervising 26 children inside the classroom. To be a fully qualified teacher, a teacher shall have Twelve post-secondary semester or equivalent quarter units in early childhood education or child development completed. On 10/16/2024, LPA reviewed transcripts for two staff and found staff #1 (S1) is not a fully qualified teacher. During staff interviews 10/16/2024, S1 stated they have completed 3 units. LPA reviewed video recordings and observed one teacher (staff #2) and one aide (S1) caring for more than 20 children inside classroom 121. 101216.3 Teacher-Child Ratio (b) The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. On 10/18/2024, LPA contacted seven parents via phone call. Three parents were able to be interviewed. Parents interviewed did not divulge any information pertaining to the allegation. Children were not interviewed due to age and being non-verbal. Based on staff interviews and observation of video recordings; the preponderance of evidence standard has been met; therefore, the above allegation alleging (1) Facility is operating out of ratio is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division & Chapter 12, is being cited on the attached LIC 9099 D for the deficiency section 101216.3 Teacher-Child Ratio (b) The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. In the areas that were evaluated, one Type A deficiency was observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. LPA Dean Thompson informed Director Christina Naffziger that this report dated 10/28/2024, document(s) one Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Continue to Page 3 Page 3 Also, LPA Dean Thompson informed the Director Christina Naffziger to provide a copy of this licensing report dated 10/28/2024, that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and report was reviewed with Director Christina Naffziger. Notice of Site Visit was provided to Director Christina Naffziger and posted on the door. The notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The licensee was provided a copy of their appeal rights (LIC 9058 1/16) and their signature on this form acknowledges receipt of these rights. Reporting Party (RP) alleges Facility staff didn't intervene when children were fighting. RP disclosed on 09/13/2024, during pick up time, two children were fighting over a toy in the playground and one child, put the other child, in a choke hold. RP stated staff present, did not intervene. On 10/16/2024, LPA interviewed two staff. Staff interviewed stated no one disclosed any information to them pertaining to the allege incident and that they didn’t witness the allege incident happen. On 10/16/2024, LPA reviewed files. LPA didn’t observe any incident reports pertaining to the allegation inside the children files. On 10/18/2024, LPA contacted seven parents via phone call. Three parents were able to be interviewed. Parents interviewed did not divulge any information pertaining to the allegation. LPA interviewed three children; children interviewed did not divulge any information pertaining to the allegation. Based on file reviews, LPA interviews with staff, parents, and children, there was not enough evidence to substantiate the allegations. The Orange County Child Care Office has investigated the complaint alleging (1) Facility staff didn't intervene when children were fighting : although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. In the areas that were evaluated, no deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. Exit interview conducted and report was reviewed with Director Christina Naffziger. Notice of Site Visit was provided to the Director. The notice of site visit must be posted for 30 consecutive days.     101161(a) Limitations on Capacity: A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. Based on observation, interview, and record review, the licensee did not comply with the section cited above in that, one (1) infant was comingling in the preschool, which poses an immediate health, safety or personal rights risk to persons in care.
