What the inspector wrote

However, the staff member was on her cell phone sitting on a child’s bench and she yelled at the children, “I can’t help you, you clean yourselves! She seemed furious.” In addition, the complainant also stated, In the outdoor play area, they observed an old wooden play kitchen with black and green mold on its surface covering approximately 10 inches in diameter.” During the course of investigation, LPA interviewed 8 staff members, 10 children, and 6 parents. 6 out of 6 parents interviewed did not make any disclosures. While touring the facility LPA observed the wooden play kitchen that was in the outside play yard and LPA saw that it was in disrepair, it had green mold and the cabinet doors were cracked and weathered, the wood stain was chipping off. LPA took two photographs depicting the condition of the wooden play kitchen. When LPA asked Staff 7(S7) and Staff 8 (S8) about the condition of the play kitchen both agreed that it was in poor condition and should be removed. 6 out of 10 children interviewed stated the wooden kitchen was old. C10 stated that no kids liked played with it because it was so old and they like the other one (plastic) by the grass better. The wooden play kitchen was removed the same day on 05/23/2023. During the staff interview, Staff 1 (S1) stated, “Staff 4 (S4) yells at the children, S4 yells at them for no reason. S4 has no patience for the children and always gets mad and tired. S1 also stated witnessing children cry from S4 yelling. Staff 8 (S8) disclosed, “I have once talked to one of our assistant teachers, S4. We had a discussion with S4 last year, it was reported to me that S4's tone was sometimes too loud” 1 of 10 children interviewed disclosed that a teacher yells. Child #4 (C4) stated their teacher yells at children when they get in trouble. The 6 interviewed parents had no issues or concerns with the facility. Based on interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED . California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101239 Fixtures, Furniture, Equipment and Supplies and Section 101223(a)(3) Personal Rights is being cited on the attached LIC 9099D. Please refer to attached 9099D for documentation of deficiencies. LPA Valdez Santana informed facility representative , that this report dated 06/16/23 documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Page 2 of 3 Also, LPA Valdez Santana informed the facility representative to provide a copy of this licensing report dated 06/16/23 , that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification Exit interview was conducted. The Notice of Site Visit was posted. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) was provided and their signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report.

This requirement is not met as evidence by: Based on LPA’s interviews, S1 stated observing S4 yell at children. S8 disclosed that it was reported to S8 that S4 was speaking too loudly to children in care so S8 spoke to S4 about S4’s tone. C4 disclosed C4’s teacher yells at them (children) when they get in trouble.

    Fixtures, Furniture, Equipment and Supplies-(m) All play equipment and materials used by children shall be age-appropriate.(1) The licensee shall provide a variety of age-appropriate equipment, toys and materials in good condition and in sufficient quantity to allow children present to fully participate in planned activities.This requirement is not met as evidence by: Based on LPA’s interviews, observations and photographs taken while touring the facility, shows a wooden play kitchen with mold and in disrepair.
