What the inspector wrote

On 3/21/24, the LPA spoke with the reporting party (RP) who stated the report was not provided until March 19th. RP shared documents corroborating the allegation. The report and Type A citations were originally issued on 3/05/24. On 3/27/2024, the LPAs called 15 parents for an interview about the allegations. Seven of the parents disclosed they first received a copy of the report sometime between March 18 and March 25. One parent stated they received the report immediately after the visit. Three parents were unsure of the date when they received the report. One parent stated they did not receive the report. The rest of the parents were unavailable or did not answer the Department’s request for information. On 3/29/2024, the LPA interviewed one staff at the facility. Staff stated that the report was posted immediately, and a copy was sent to the parents on the 19. A copy of the original emailed send to the parents was obtained. On 3/29/2024, the LPA reviewed records related to the allegations. Twenty-two LIC9224 Acknowledgement of Receipt of Licensing Report forms were reviewed. The dates on the receipts range from March 19th to March 25th. A copy of child attendance records for March 6 through March 20 shows children were in attendance. A printout shows the report was originally sent to parents electronically on March 19. Based on the LPA’s observations and conducted interviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. A substantiated finding means that the complaint is substantiated, and the allegations are valid because the preponderance of the evidence standard has been met. Per HSC 1596.8595(c)(1) a reports must be provided to parents or guardians. The licensing report informs the licensee to An exit interview was conducted with Admin Assistant Ashlliegh Salazar and Licensee Leslie Lucy. The Notice of Site Visit was posted during the visit. The director was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First-level appeals should be sent to the regional manager to the address listed above.
