ARTICLE 2. Administration of Child Day Care Licensing

1596.8595 (c)(1) Health & Safety: A licensed child day care facility shall provide to the parents or guardians of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal…this requirement was not met as evidenced by licensee interview and a child file that did not have the LIC 9224 acknowledgment of licensing report.

CRIMINAL RECORD CLEARANCE

Criminal Record Clearance 102370(d)(1): All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility:(1)Obtain a California clearance or a criminal record exemption as required by the Department this requirement was not met as evidenced by a paid adult providing assistance to children with no fingerprint clearance which posses an immediate health and safety risk to the children in care.

STAFFING RATIO AND CAPACITY

Staffing Ratio & Capacity 102416.5(a): The capacity specified on the license shall be the maximum number of children for whom care may be provided at any one time. This requirement was not met as evidenced by observation during inspection that 22 children were present being supervised by 3 staff. This posses an immediate health and safety risk to the children in care.

OPERATION OF A FAMILY CHILD CARE HOME

Operation of a Family Child Care Home 102417(a): Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. This requirement was not as evidenced by observations and interviews that revealed licensee was absent from Monday- Wednesday which posses a potential risk to the children in care.

On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement was not met. LPA observed expired Mandated reporter certificates for all staff. This is a potential health and safety risk to children in care.

Poisons, detergents, cleaning compounds, medicines, firearms and other items which could pose a danger if readily available to children shall be stored where they are inaccessible to children. Poisons shall be locked.This requirement was not met when LPA observed cleaning supplies under the kitchen sink (bleach, pledge and cleaners). The storage area did not have child safety locks making the items accessible to children. In addition, poisons such as Raid and weed killer were stored in the locked garage however the items were not locked in and individual storage area. These items pose an immediate health and safety risk to children in care.

Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement was not met when LPA did not observe the assistant Gigi immunizations to measlese, pertussis or flu.
