What the inspector wrote

Evidence was conclusive that Staff #3 was previously observed by other staff members smoking the vape pen in the staff break room at the facility. Administration was not aware of Staff #3 smoking in the break room until after the incident occurred on 12/15/22. Based on the evidence that was gathered, LPA determined the preponderance of evidence standard has been met, therefore, the allegations are determined to be substantiated. Type A Deficiency LPA Jeremey McClain informed facility representative Jenny Aguilar that this report dated January 11th, 2023, documents 1 Type A citation which shall be posted for 30 consecutive days as there was immediate risk to the health, safety, or personal rights of children in care. Also, LPA Jeremey McClain informed the licensee Jenny Aguilar to provide a copy of this licensing report dated January 11th, 2023, that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Posting Requirements Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal Rights were provided, and an exit interview was conducted. A Notice of Site Visit was posted and must remain posted for 30 days.

(a)The licensee shall ensure that each child is accorded the following personal rights:(2)To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement was not as evidenced by interviews during a complaint investigation and an unusual incident report that was reported to LPA via email on 12/21/22. On 12/15/22, Child #1 was found with a vape pen in her mouth by Staff #1 and Staff #2, after it was left on the playground from Staff #3. Evidence was also conclusive that Staff #3 previously used the vape pen in the staff break room on site. This posed an immediate risk to health and safety of children in care.
