PERSONAL RIGHTS
Personal Rights. (a)The licensee shall ensure that each child is accorded the following personal rights: (1)To be accorded dignity in his/her personal relationships with staff and other persons. This requirement was met as evidenced by admission, review of footage,and through interviews. Former staff were observed placing a child in their seat in a rough manner and pushing them toward the table. The same staff was also observed moving children in a manner that was inappropriate by grabbing them by their jacks or sweaters. Another former staff was also observed pulling a child up by one arm in a manner harmful to the child. This posed an immeidate risk to the health and safety of chidlren in care.

Observation of the Child. The behavior and health of the children shall be continually observed throughout the period of attendance. This requirement was not met as evidenced by interviewes. It was conclusive that mutiple children on more than once occassion were picked up by their guardian with a full diaper. Evidence was also conclusive that multiple were observed to have diaper rash after being picked up from the facility. This poses a potential risk to the health and safety of children in care if not corrected.

Food Services. (14)All persons engaged in food preparation and service shall observe personal hygiene and food- service sanitation practices that protect food from contamination. This requirement was not med as evidenced through admission. On 04/08/2025, Staff 3 was observed feeding themselves a food item with their fingers and then proceeded to serve children food without washing their hands or putting on gloves. If not corrected, this poses a potential risk to the health and safety of children in care.

Teacher-Child Ratio. (a)There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below. This requirement was not met as evidenced by staff interviews. It was confirmed that a staff supervised more than 12 children for a period of at least 15 minutes by themselves in the opening room. It was also confirmed that staff have previously supervised more than 12 children alone on multiple occassions other than this morning. This is considered an immediate risk to the health and safety of children in care.

(a)The licensee shall ensure that each child is accorded the following personal rights:(2)To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement was not as evidenced by interviews during a complaint investigation and an unusual incident report that was reported to LPA via email on 12/21/22. On 12/15/22, Child #1 was found with a vape pen in her mouth by Staff #1 and Staff #2, after it was left on the playground from Staff #3. Evidence was also conclusive that Staff #3 previously used the vape pen in the staff break room on site. This posed an immediate risk to health and safety of children in care.
