Inspector’s narrative

What the inspector wrote

No Title 22 deficiencies will be issued as a result of the investigation. LPA reviewed this report with facility representative Teresa Cortes and provided a Notice of Site Visit that must be posted for 30 days. LPA observed footage of a former staff placing a child in their seat in a rough manner and pushing them toward the table. Evidence was also conclusive that this same staff was also observed moving children in a manner that was inappropriate by grabbing them by their jacks or sweaters. Another former staff was also observed pulling a child up by one arm in a manner harmful to the child. The facility admitted that on once occasion, a staff member fed themselves a food item with their fingers and then proceeded to serve children food without washing their hands or putting on gloves. The preponderance of evidence standard has been met; therefore, the allegations are determined to be SUBSTANTIATED. Deficiencies are documented on the 809-D pages of this report. An exit interview was conducted with facility representative Teresa Cortes. A Notice of Site Visit was provided and shall remain posted for 30 days. LPA Jeremey McClain informed licensee Tere Cortes that this report dated 05/12/2025 documents one Type A citation which shall be posted for 30 consecutive days as there was an immediate risk to the health, safety, or personal rights of children in care. Also, LPA Jeremey McClain informed licensee Tere Cortes to provide a copy of this licensing report dated 05/12/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. (2/2)

  • PERSONAL RIGHTS

    Personal Rights. (a)The licensee shall ensure that each child is accorded the following personal rights: (1)To be accorded dignity in his/her personal relationships with staff and other persons. This requirement was met as evidenced by admission, review of footage,and through interviews. Former staff were observed placing a child in their seat in a rough manner and pushing them toward the table. The same staff was also observed moving children in a manner that was inappropriate by grabbing them by their jacks or sweaters. Another former staff was also observed pulling a child up by one arm in a manner harmful to the child. This posed an immeidate risk to the health and safety of chidlren in care.

    Observation of the Child. The behavior and health of the children shall be continually observed throughout the period of attendance. This requirement was not met as evidenced by interviewes. It was conclusive that mutiple children on more than once occassion were picked up by their guardian with a full diaper. Evidence was also conclusive that multiple were observed to have diaper rash after being picked up from the facility. This poses a potential risk to the health and safety of children in care if not corrected.

    Food Services. (14)All persons engaged in food preparation and service shall observe personal hygiene and food- service sanitation practices that protect food from contamination. This requirement was not med as evidenced through admission. On 04/08/2025, Staff 3 was observed feeding themselves a food item with their fingers and then proceeded to serve children food without washing their hands or putting on gloves. If not corrected, this poses a potential risk to the health and safety of children in care.
