What the inspector wrote

Licensing Program Analyst (LPA) Samuel Lopez arrived at the facility to conduct a case management visit in response to the receipt of an Unusual Incident Report (UIR). The UIR was received by the licensing department on 5/7/2025. The UIR documented an incident involving a two children playing with a rope and one child injuring themselves as a result. Upon arrival this date on 5/20/2025, LPA Lopez met with facility Director Deborah Angulo and explained the purpose of the visit. Records were reviewed and interviews were conducted. The following information was provided/obtained: Children were outside on the playground, a child found a rope/strap attached to a canopy that is used at the facility for shade. The child began to play with the rope/strap and began to tell other children to put it around their neck. Initially, children did not listen however, moments later, the child walked over to another asking if they would put the rope/strap around their neck. The child who initially found the rope/strap had another child place the rope/strap on their neck and began puling on it. This, left red marks on the child's neck, that were described similar to rug burns. The actions/details leading up to the incident were provided by children and were not observed by staff that were present on the playground. Staff/teachers only became aware of the incident/injury as it occurred. Based on the information gathered, facility failed to comply with regulation section 101229, which reads that the licensee shall provide care and supervision as necessary to meet the children's needs.. See LIC809-D for cited deficiency. LPA Samuel Lopez informed Director Deborah Angulo that this report dated May 20 , 2025, document(s) (1) Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Samuel Lopez informed the Director Deborah Angulo to provide a copy of this licensing report dated May 20 , 2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the Director Deborah Angulo.

    Responsibility for Providing Care and Supervision: The licensee shall provide care and supervision as necessary to meet the children's needs. This requirement was not being met as evidenced by information obtained during interviews, the licensee did not comply with the section cited above. A child was able to gain access to a strap, from a canopy located on the playground, and use it to place on another child's neck, causing visual marks on the child. Staff/teachers became aware of the incident as it occurred and not action leading up to it.
