This requirement is not met as evidenced by: Based on interviews and record review, the licensee did not comply with the section cited above. The facility failed to report incidents to theparents/legal guardians and follow their own admission policies as stated on the Parent Handbook, regarding discipline and repeat aggressive/inappropriate behaviors.     RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    Responsibility for Providing Care and Supervision: The licensee shall provide care and supervision as necessary to meet the children's needs. This requirement was not being met as evidenced by information obtained during interviews, the licensee did not comply with the section cited above. A child was able to gain access to a strap, from a canopy located on the playground, and use it to place on another child's neck, causing visual marks on the child. Staff/teachers became aware of the incident as it occurred and not action leading up to it.

    Reporting Requirements: Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. This requirement was not met as evidenced by:

  • CHILD CARE CENTER DIRECTOR QUALIFICATIONS AND DUTIES

    Child Care Center Directors Qualifications and Duties: When the child care center director is absent from the center, arrangements shall be made for a fully qualified teacher as specified in Section 101216.1(c) to act as substitute. This substitute child care center director shall be aware of center operations, including total enrollment; shall be trained in program operation; and shall be designated as an authorized person to correct operational deficiencies that constitute immediate threats to children's health and safety. This requirement is not met as evidenced by:

  • PERSONAL RIGHTS

    Personal Rights: To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement is not met as evidenced by: Based on interview and observation, a staff grabbed two children, picking them up off the ground, and then tossing them back down onto the activity rug, causing one child to

In conducting children record reviews, LPA observed an admission agreement for Child #8 to be in the infant/toddler program however, the child was in a Pre-K classroom. There was no updated Admission agreement to reflect the change. This poses/posed a potential health, safety or personal rights risk to persons in care.

LPA observed Albuterol being stored, for a child in care, however there was no label with directions from the physician and no prescription/medical documents on file.   • ARTICLE 1. General Provisions and Definitions

    Based on record review, the licensee did not comply with the section cited above. In reviewing staff records it was determined that Staff #3, did not have all the required immunizations. This poses/posed a potential health, safety or personal rights risk to persons in care.

  • ARTICLE 2. Administration of Child Day Care Licensing

    Based on record review, the licensee did not comply with the section cited above. In reviewing staff records it was determined that Staff #2 and Staff #3, did not have current proof of completion for the required training. This poses/posed a potential health, safety or personal rights risk to persons in care.

  • TEACHER QUALIFICATIONS AND DUTIES

    Based on observation and record review, the licensee did not comply with the section cited above. In touring the facility LPA observed Staff #5, alone with children and in reviewing their file, it was determined that they were missing the required Child, Family, and Community course. This poses an immediate health, safety or personal rights risk to persons in care.
