Based on specific date(s) and time(s) that were obtained during the investigation, LPA Lopez requested to and was allowed to review footage recorded from the classroom. In the recorded footage LPA Lopez observed a staff/teacher walk inside the classroom restroom to assist the children. The staff/teacher could not be seen on the video camera as they entered the restroom but the door to the restroom remained completely open. Moments later, while the staff/teacher was inside the restroom, a person (later identified as a parent) appeared in the video and looking inside the classroom, from the hallway, through a window on one of the classroom doors. The person could be seen knocking on the window before moving over to another door and knocking on the window of that door. Less than a minute later, the staff/teacher emerges from the restroom with the children and opens the classroom door. The person can be seen pointing at a corner of the classroom, that was not visible by the video camera, and talking to the staff/teacher, at the same time. Seconds later, the teacher and person walked over to the corner, which were then no longer visible on the video camera. The person is then seen walking away with a child in their arms, heading to the door, grabs what appears to be a water bottle, before exiting the classroom. Seconds later, the person returns to retrieve a blanket/sheet, before leaving once again. Based on the video camera location, which faces the classroom doors, the blind spot(s) that exists underneath its mounted location, and the footage reviewed, a determination could not be made as to what occurred between children and staff and child, as alleged. Additionally, in the course of the investigation, interviews with all pertinent parties, including the subject child(ren), were not able to be conducted. Based on the information obtained, and although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is unsubstantiated. A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with Supervisor Frances Gonzalez.
