What the inspector wrote

On 2/20/25 and 12:40 listed, Licensing Program Analyst (LPA) Naomi Hurtado arrived at the facility to conduct an annual inspection as part of a compliance review. LPA toured the facility, inside and out, records were reviewed, and the following was observed and/or discussed: \342\200\242 Normal days and hours of operation are: Mon. \342\200\223 Fri. 4 AM- 4PM \342\200\242 Off-limit areas include: Bedrooms, kitchen, laundry, and right/back of the yard \342\200\242 The facility is licensed to have no more than 8 children as a small FCCH and is operating within the licensed capacity and appropriate ratios. 4 children were present during the inspection \342\200\242 Appropriate supervision was being provided during this inspection \342\200\242 A working telephone is present, and the current phone number is on file \342\200\242 A fully charged fire extinguisher (2A:10BC) was observed. A smoke detector and carbon monoxide detector were present and tested by the Licensee during this inspection. \342\200\242 There is no fireplace (heater shaped as fireplace). \342\200\242 All hazardous items are stored inaccessible to children \342\200\242 Toxins were not locked and were accessible to children in care but removed at visit. \342\200\242 Weapons are not present. Licensee understands all guns, weapons and ammunition must be key locked separately and made inaccessible per Title 22 Regulations \342\200\242 There are no stairs \342\200\242 Clean, safe, and age-appropriate toys are provided \342\200\242 Current roster on file \342\200\242 Facility Sketch, Emergency Disaster Plan and Notification of Parent\342\200\231s Rights poster are posted \342\200\242 There is no documentation of fire and disaster drills since being licensed \342\200\242No bodies of water are present at this time. Licensee understands all bodies of water including ponds, above ground pools & spas, in-ground pools & spas, and some fountains must be properly covered or fenced per Title 22 Regulations. The Department must be notified before and after installation of the above types of bodies of water. In addition, all wading pools or similar product must be emptied immediately after use and stored in an upright position. \342\200\242 Verification of control of property is on file \342\200\242 Children\342\200\231s records are not complete \342\200\242 Employee\342\200\231s records are complete \342\200\242 Mandated Reporter Training completed on 1/2024 \342\200\242 Pediatric CPR and First Aid Card expires on 9/2025 \342\200\242 Health & Safety Certificate - completed on 10/18/23 \342\200\242 Resident and/or staff records were reviewed and all adults who require caregiver background checks have received all required clearances and/or exemptions. Licensee was reminded that all adults 18 and over, living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. One can add their email address and choose which program(s) they wish to receive Provider Information Notices (PIN) for. The Duty Officer is available to answer questions Monday \342\200\223 Friday; 8:00am to 5:00pm at: 951-782-4200 See LIC809-D for cited deficiencies During the exit interview, the Licensee Maribel Samaniego , confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. A notice of site visit was given and must remain posted for 30 days. An exit interview was conducted, and this report was reviewed with the licensee Maribel Samaniego. Appeal rights were discussed and provided during the exit interview.

    Based on observation, LPA observed a chlorine gallon was on a lower shelf in the laundry room; one has to pass the kitchen to access the laundry room. The kitchen is off-limits and has a safety gate but, it was not locked when LPA arrived. The licensee did not comply with the section cited above in which poses a potential health, safety or personal rights risk to persons in care.

    Based on observation, Child 1 was sleeping with a folded blanket as a pillow and had an addition blanket covering the child. There was also an attachment hanging above the crib. The licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.

    Based on observation, the licensee did not comply with the section cited above in which poses/posed a potential health, safety or personal rights risk to persons in care. LPA observed that Child 2 was asleep in a baby swing when LPA arrived. Although he woke up shortly after, Licensee stated that Child 2 can only fall asleep on the swing.

    Based on record review, the licensee did not comply with the section cited above in which poses a potential health, safety or personal rights risk to persons in care. Child 1 has no sleep log; Licensee stated the child was registered 1/21/25. Child 2 has no sleep log since Nov. 2024; Licensee admitted to not completing a sleep log since.
