What the inspector wrote

Licensing Program Analyst (LPA) Jennifer Velasco met with Facility Representative, Director Hailey Tuaumu (Director), for a case management inspection. The purpose of the inspection was explained. During a recent investigation into a complaint against the facility, LPA learned of an incident at the facility in October 2024. The incident resulted in harm to a child in care and was not reported to the Department as required per licensing regulations. Due to this, facility is being cited a Type B deficiency for not reporting an unusual incident. The Type B citation is explained in more detail on accompanying LIC 809-D continuation page. Notice of site visit was provided and must remain posted for 30 days. Exit interview was conducted with Director, who was provided with appeal rights.

What does Type A vs Type B mean?

Type A. Serious citation. Imminent or substantial risk to children. The regulator requires corrective action immediately and may impose a civil penalty.

Type B. Lower-severity citation. Corrective action required, no imminent risk. The regulator monitors compliance on the next visit.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. This requirement was not met as evidenced by the following. Based on multiple witness statements and facility documentation, one or more unobserved inappropriate interactions between children occurred due to lack of visual observation by staff. This poses an immediate threat to the health, safety, and/or personal rights of children in care.

  • REPORTING REQUIREMENTS

    (d)Upon the occurrence, during the operation of the child care center ... [of] events ... … a written report … shall be submitted to the Department within seven days ... (1) Events reported shall include ... (C) Any unusual incident .. that threatens the physical or emotional health or safety of any child. This requirement was not met as evidenced by. Based on interview and record review, the licensee did not report an unusual incident to the Department as required by reporting timelines. This poses a potential health, safety or personal rights risk to children in care.
