What the inspector wrote

Licensing Program Manager (LPM) Natalie Dunaway and Licensing Program Analyst (LPA) Erwina Pascual-Golamco met with Licensee Representative Mercy Ishida , for the purpose of an informal compliance conference. LPM defined the difference between non-compliance and informal conference. LPM advised that the purpose of today's meeting is to help the facility gain compliance. Today's informal conference was to discuss the type A and type B citations issued on the dates indicated below: 11/13/24 – Type A Licensing reports not provided to authorized representatives for previous citations 11/13/24 – Unqualified staff providing care and supervision to children 11/13/24 - Staff do not provide adequate care and supervision to the daycare children 7/24/24 – Child left without supervision 3/20/24 – Non-prescription medications accessible to children The Licensee Representative stated that they have taken the following steps to maintain compliance: 1. Licensee will do a file review and will determine which parent/s need LIC9224 and will provide the all newly enrolled children for the next 12 months. 2. Licensee will provide a staffing plan to LPA by 4PM November 15, 2024. 3. Licensee will conduct training on supervision/ratio and will provide LPA verification of training by 4PM December 2, 2024. LPA discussed follow up documentation for file. LPA and LPM reviewed personal rights and supervision requirements. LPA discussed using the Department website (ccld.ca.gov) for child care updates, current forms, legislation and regulation information. LPM and LPA provided information regarding the Technical Support Program (TSP), which is a non-enforcement arm of the Community Care Licensing Division offering onsite support to licensees and providers. Director will follow up with request to LPA for TSP services. LPM suggested that Licensee can view information videos at www.ccld.childcarevideos.org . This report was reviewed with the Licensee Representative.

(1) No child(ren) shall be left without the supervision of a teacher at any time...shall include visual observation.This requirement is not met as evidenced by: based on interview, and witness statements, Licensee (L) did not comply with the section cited above as on at least one occasion, a child was reported to have ran away from the facility when children were in the play yard and child pushed open the gate leading to the parking lot, which poses an immediate health, safety, or personal rights risk to persons in care.

This requirement is not met as evidenced by:based on record review, Licensee (L) did not comply with the section cited above, LPA reviewed sample of children's files on 10/09/24 visit. Out of 6 sample files, 3 had the signed LIC9224 for citation date 09/20/23 only, none for 07/24/24 and 3 files did not have any LIC9224 for verification, which poses a potential health, safety, or personal rights risk to persons in care.
