101239 Fixtures, Furniture, Equipment and Supplies (a) A comfortable temperature for children shall be maintained at all times. This requirement was not met as evidenced by multiple witness statements that for one or more days children were in care, the facility provided care despite the fact that the indoor temperature was uncomfortably high, causing the children discomfort. This constitutes a potential risk to the health, safety, and/or personal rights of children in care.

101216.1 Teacher Qualifications and Duties(b) Prior to employment, a teacher shall meet the requirements of (b)(1) or (b)(2) below:...This requirement is not met as evidenced by: based on interviews, observations, and record reviews, Licensee (L) did not comply with the section cited above as staff present at the preschool facility are aids and did not have direct supervision of a teacher, which poses a potential health, safety, or personal rights risk to persons in care.

This requirement is not met as evidenced by:based on record review, Licensee (L) did not comply with the section cited above, LPA reviewed sample of children's files on 10/09/24 visit. Out of 6 sample files, 3 had the signed LIC9224 for citation date 09/20/23 only, none for 07/24/24 and 3 files did not have any LIC9224 for verification, which poses a potential health, safety, or personal rights risk to persons in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

101229 Responsibility for Providing Care and Supervision (a)The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time...shall include visual observation.This requirement is not met as evidenced by: based on interview, and witness statements, Licensee (L) did not comply with the section cited above as on at least one occasion, a child was reported to have ran away from the facility when children were in the play yard and child pushed open the gate leading to the parking lot, which poses an immediate health, safety, or personal rights risk to persons in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

101229 Responsibility for Providing Care and Supervision (a)The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time...shall include visual observation. This requirement is not met as evidenced by:based on interview, and record reviews, Director (D) did not comply with the section cited above as a children were left unsupervised in the play yard at two instances. D stated that a staff took a child indoors, leaving other children in their care in the play yard unsupervised, which poses an immediate health, safety, or personal rights risk to persons in care.

BUILDINGS AND GROUNDS

101238 Buildings and Grounds(g) Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children. This requirement was not met as evidenced by: LPA observed that the cubbies in the preschool bathroom had diaper creams and over the counter ointments that are accessible to children which poses a potential health, safety, or personal rights risk to persons in care.

REPORTING REQUIREMENTS

101212 Reporting Requirements (d)...any of the events specified in (d)(1) below, a report shall be made to the dept. by telephone or fax within the dept...next working day...In addition, a written report...submitted...to the dept...within seven days...(C)Any unusual incident ...that threatens...or safety of any child. This requirement was not met as evidenced by: based on interview, and record review, Director did not comply with the section cited above as incident on 7/20/23 was not reported to the dept. the next working day, which poses a potential health, safety, or personal rights risk to persons in care.

101216 Personnel Requirements:(i) Prior to employment or initial presence in the child care center, all employees and volunteers subject to a criminal record review shall:(1)Obtain a California clearance or a criminal record exemption as required by law... This requirement is not met as evidenced by LPA's record review, interviews, and observation of the presence of one working staff member who have not obtained criminal background clearance, which poses an immediate health and safety risk to children in care.

OBSERVATION OF THE CHILD

(b) Any unusual behavior, any injury or signs of illness requiring assessment and/or administration of first aid by staff shall be reported to the child's authorized representative and recorded in the child's record. this requirement was not met as evidence by witness statements and documentation that staff failed to provide authorized representative with an incident/injury report. This is a potential risk to health, safety and or personal rights of children incare.
