What the inspector wrote

Licensing Program Analysts (LPAs) Erwina Pascual-Golamco and Jennifer Velasco conducted a Plan of Correction visit today to clear the deficiency cited on 04/08/24. LPAs toured the facility, reviewed facility documents, and observed Licensee providing care to children. Licensee was cited for Type A CCR 102416.5 (b)(3)(a): 102416.5 Staffing Ratio and Capacity (b)For a Small Family Child Care Home, the maximum number of children for whom care may be provided at any one time, including children under age 10 who reside at the licensee's home, shall be one of the following: (3)More than six and up to eight children, without an additional adult attendant, only if the criteria in Section 1597.44 of the Health and Safety Code are met. Health and Safety Code section 1597.44 states: A small family day care home may provide care for more than six and up to eight children, without an additional adult attendant, if all of the following conditions are met: (a)At least one child is enrolled in and attending kindergarten or elementary school and a second child is at least six years of age. As of today, 04/29/24, Licensee meets Small Family Childcare Home Ratio and Capacity. LPA observed Licensee providing care to 1 infant and 3 preschool aged children. Deficiency cleared in today's inspection, exit interview was conducted, and Notice of Site visit was provided and shall be posted where visible to parents for 30 days.

    102416 Personnel Requirements(c) The licensee and other personnel as specified shall complete training on preventive health practices, including pediatric cardiopulmonary resuscitation and pediatric first aid, pursuant to Health and Safety Code Section 1596.866.This requirement is not met as evidenced by: Based on observation and interview, LPA determined and Licensee confirmed that adult assistant who was left with children today, did not have Pediatric First Aid/CPR certification, which poses an immediate health, safety or personal rights risk to persons in care.

    102425 Infant Safe Sleep(j) The provider shall supervise infants while they are sleeping and adhere to the following requirements:5) If the infant is sleeping in a separate room from where the provider is stationed, the door to the room the infant is sleeping in shall remain open at all times.This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above as LPA observed one infant asleep with door closed and adult at the facility was in backyard with other children at play, which poses an immediate health, safety or personal rights risk to persons in care.
