102370 Criminal Record Clearance(d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility:(1)Obtain a California clearance or a criminal record exemption as required by the DepartmentThis requirement is not met as evidenced by: Based on observation, interview, and record review, the licensee did not comply with the section cited above as LPA observed one uncleared adult at the facility during hours of operation which poses an immediate health, safety or personal rights risk to persons in care.

PERSONNEL REQUIREMENTS

102416 Personnel Requirements(c) The licensee and other personnel as specified shall complete training on preventive health practices, including pediatric cardiopulmonary resuscitation and pediatric first aid, pursuant to Health and Safety Code Section 1596.866.This requirement is not met as evidenced by: Based on observation and interview, LPA determined and Licensee confirmed that adult assistant who was left with children today, did not have Pediatric First Aid/CPR certification, which poses an immediate health, safety or personal rights risk to persons in care.

INFANT SAFE SLEEP

102425 Infant Safe Sleep(j) The provider shall supervise infants while they are sleeping and adhere to the following requirements:5) If the infant is sleeping in a separate room from where the provider is stationed, the door to the room the infant is sleeping in shall remain open at all times.This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above as LPA observed one infant asleep with door closed and adult at the facility was in backyard with other children at play, which poses an immediate health, safety or personal rights risk to persons in care.

102416.5 Staffing Ratio and Capacity (b) For a Small Family Child Care Home, the maximum number of children for whom care may be provided at any one time...(3)more than six and up to eight children...if all of the following conditions are met:(a)At least one child is enrolled in and attending kindergarten or elementary school and a second child is at least six years of age. This requirement was not met as evidenced by: on 3/28/24, Licensee stated she had 8 children in care, none were enrolled in and attending kindergarten or elementary school and is at least six years of age, which poses an immediate health and safety risk to children in care.

CRIMINAL RECORD CLEARANCE

102370 Criminal Record Clearance(d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility:(2) Request a transfer of a criminal record clearance as specified in Section 102370(j)...This requirement is not met as evidenced by: Based on observation, interview, and record review, the licensee did not comply with the section cited above as LPA observed 2 adult assistants were not associated to the facility which poses an immediate health, safety or personal rights risk to persons in care.

§1597.622 Employees or volunteers at family day care home; immunization requirements; records; exemptions...(a)(2) If a person meets all other requirements for employment or volunteering, as applicable, but needs additional time to obtain and provide his or her immunization records, the person may be employed or volunteer conditionally for a maximum of 30 days upon signing and submitting a written statement attesting that he or she has been immunized as required. .This requirement is not met as evidenced by:Licensee did not have required documentation for 2 staff for LPAs to check at time of LPA visit. Licensee showed documentation od CPR/FA for 1 staff.
