Licensing Program Analyst (LPA) Deanna Villagrana met with licensee Claudia Alvarado for a required one year visit. LPA explained the nature of today\342\200\231s inspection to her. Present were licensee, licensee's adult daughter and her husband, her 16 and 13 year old daughters and one day care child who is an infant. Days and hours of operation are Monday to Sunday, 5:00am to 7:00pm. The adults that reside in the home are licensee, her husband, two adult daughters, adult son in law, adult son with her two daughters age 16 and 13, and her four grandchildren ages 10, 8, 7 and 4. LPA requested licensee to complete an new LIC279 and LIC279B stating who lives in the home. Licensee's daughter and son in law moved back into the home approximately 6 months ago. Licensee did not notify the Department. Licensee's son in law Jose Sanchez does not have a current TB test on file. A review of staff records on 12/06/2021 indicates that not all Facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. LPA observed licensee's son Enrique Martinez has not obtained criminal record clearance. Licensee Claudia Alvarado was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. LPA toured the indoor and outdoor areas of the home during today\342\200\231s inspection. LPA observed dog feces in the backyard play area for children. LPA observed a barricaded fireplace in the home. LPA observed safe and sufficient materials, toys, and play equipment for the day care children. All sharp objects, detergents, cleaning compounds, medications, poisons, and other similar items inside the home are stored inaccessible to children. LPA observed a fully charged 3A40BC fire extinguisher. LPA observed a working combo smoke and carbon monoxide detector. Licensee states there are no weapons/firearms in the home. Off limit areas indoor: master bedroom/bath, three bedrooms, two hallway closets and attached garage. There are no bodies of water. Backyard is fenced. Off limits outdoor: left, right and back side of home that is fenced off to children and locked storage. Licensee states she has four dogs that stay on the left side of the home. LPA observed licensee has a current CPR and First Aid certification expiring 07/04/2023 and completed Mandated Reporter training on 05/24/2021. LPA observed a current roster of the children and a fire and disaster drill log which was last completed on 11/21/2021. LPA reviewed seven children's files and observed all forms are complete. Child 6 did not have current immunization records on file. Mother of child came during visit to show updated record. LPA observed day care is insured with Assure Insurance and expires on 03/28/2022. LPA discussed SB792 Immunization Requirements and observed licensee has immunization records on file. Supervision of children was discussed with licensee and she understands that she must be present in the home during day care hours and ensure that the children are supervised at all times. Licensee understands her capacity options and she understands that she cannot have more than 14 children in the home at any time. Licensee understands if she transports children via vehicle, children cannot be left in parked vehicles unattended at any time. LPA discussed the safe sleep regulations with licensee Claudia Alvarado and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee Claudia Alvarado of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA discussed Zero Tolerance related regulations with licensee Claudia Alvarado and was advised of the assessment of $500 immediate civil penalty and an ongoing $100 per day per violation continues until the violation(s) is corrected. LPA discussed the requirements of AB633 to licensee Claudia Alvarado and provided her the AB633 fact sheet and a copy of Acknowledgement of Receipt of Licensing Reports (LIC 9224) and licensee understands the requirements. Upon receipt, licensee Claudia Alvarado shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. Incidental Medical services (IMS) policy was discussed. For IMS information see Evaluator Manual \342\200\223 Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Exit interview conducted and report was reviewed with the licensee Claudia Alvarado. The following type A and B deficiencies were cited on the attached page (809-D). Licensee was informed that failure to correct the deficiencies by the specified Plan of Correction (POC) Due Date may result in assessment of civil penalties in the amount of $100 per day per violation until the correction is m ade. A notice of site visit was given and must remain posted for 30 days.
